VIII. a. ORDINANCE 5, 2021 – (2ND READING & ADOPTION) VOLUNTARY ANNEXATION REQUEST. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM BEACH GARDENS, FLORIDA, ANNEXING, PURSUANT TO A PETITION FOR VOLUNTARY ANNEXATION, A PARCEL OF REAL PROPERTY COMPRISING A TOTAL OF 0.13 ACRES, MORE OR LESS, LOCATED ON THE NORTH SIDE OF BOMAR DRIVE APPROXIMATELY 400 FEET WEST OF THE INTERSECTION OF U.S. 1 AND BOMAR DRIVE, IN PALM BEACH COUNTY, FLORIDA, THAT IS MORE PARTICULARLY DESCRIBED HEREIN; DECLARING THAT THE VOLUNTARY ANNEXATION PETITION BEARS THE SIGNATURE OF THE OWNER OF THE REAL PROPERTY ANNEXED HEREBY; AMENDING ARTICLE II OF THE CITY CHARTER BY REDEFINING THE CORPORATE LIMITS; PROVIDING FOR TRANSMITTAL TO THE FLORIDA DEPARTMENT OF STATE, THE PALM BEACH COUNTY CLERK OF COURT, AND PALM BEACH COUNTY; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE, AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.
VIII. b. ORDINANCE 6, 2021 – (1ST READING) DOWNTOWN PALM BEACH GARDENS REQUESTING A LARGE SCALE COMPREHENSIVE PLAN MAP AMENDMENT. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM BEACH GARDENS, FLORIDA, ADOPTING A LARGE-SCALE AMENDMENT TO ITS COMPREHENSIVE PLAN FUTURE LAND USE MAP IN ACCORDANCE WITH THE MANDATES SET FORTH IN CHAPTER 163, FLORIDA STATUTES, SPECIFICALLY SECTION 163.3184, ET SEQ., FLORIDA STATUTES, PURSUANT TO APPLICATION NO. CPMA-20-04-000030 IN ORDER TO CHANGE THE LAND USE DESIGNATION ON 49.04 ACRES FROM PALM BEACH GARDENS PROFESSIONAL OFFICE (PO) TO PALM BEACH GARDENS MIXED USE (MXD); PROVIDING A NOTATION ON THE FUTURE LAND USE MAP PERTAINING TO THE PERMITTED LAND USE DENSITY AND INTENSITY RELATED TO THE SUBJECT PROPERTY; THE SUBJECT PROPERTY BEING LOCATED ON THE EAST SIDE OF ALTERNATE A1A BETWEEN KYOTO GARDENS DRIVE AND GARDENS PARKWAY; PROVIDING FOR COMPLIANCE WITH ALL REQUIREMENTS OF CHAPTER 163, FLORIDA STATUTES; PROVIDING FOR TRANSMITTAL TO THE FLORIDA DEPARTMENT OF ECONOMIC OPPORTUNITY (DEO) AND OTHER REVIEWING AGENCIES; PROVIDING THAT THE FUTURE LAND USE MAP OF THE CITY OF PALM BEACH GARDENS BE AMENDED ACCORDINGLY; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE, AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.
VIII. c.*ORDINANCE 7, 2021 – (1ST READING) DOWNTOWN PALM BEACH GARDENS REQUESTING TO REZONE APPROXIMATELY 49.04 ACRES. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM BEACH GARDENS, FLORIDA, REZONING CERTAIN REAL PROPERTY, SUCH PROPERTY BEING COMPRISED OF 49.04 ACRES IN SIZE, MORE OR LESS, AND LOCATED ON THE EAST SIDE OF ALTERNATE A1A BETWEEN KYOTO GARDENS DRIVE AND GARDENS PARKWAY; PROVIDING THAT THIS PARCEL OF REAL PROPERTY, WHICH IS MORE PARTICULARLY DESCRIBED HEREIN, SHALL BE REZONED FROM PLANNED COMMUNITY DEVELOPMENT (PCD) OVERLAY WITH UNDERLYING ZONING DESIGNATIONS OF GENERAL COMMERCIAL (CG-1) AND PROFESSIONAL OFFICE (PO) TO PLANNED COMMUNITY DEVELOPMENT (PCD) OVERLAY WITH AN UNDERLYING ZONING DESIGNATION OF MIXED USE (MXD); PROVIDING THAT THE ZONING MAP OF THE CITY OF PALM BEACH GARDENS BE AMENDED ACCORDINGLY; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE, AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.
VIII. d. *RESOLUTION 27, 2021 – AVENIR PLANNED COMMUNITY DEVELOPMENT (PCD) MASTER PLAN AMENDMENT. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM BEACH GARDENS, FLORIDA, APPROVING A PLANNED COMMUNITY DEVELOPMENT (PCD) AMENDMENT TO THE AVENIR PCD MASTER PLAN TO MODIFY PARCEL BOUNDARIES (INCLUDING CREATION OF A NEW INTERNAL PARCEL), SHIFT ENTITLEMENTS BETWEEN PARCELS, MODIFY THE PCD INTERNAL ROADWAY NETWORK INCLUDING ADDING DRIVEWAY CONNECTIONS, REVISE PCD AND ROADWAY BUFFER LANDSCAPE PLANS, UPDATE DEVELOPMENT STANDARDS, AND MODIFY CERTAIN CONDITIONS OF APPROVAL IN RESOLUTION 4, 2016; THE SUBJECT SITE IS 4,763 ACRES, MORE OR LESS, AND IS GENERALLY LOCATED ON THE NORTH SIDE OF NORTHLAKE BOULEVARD, EAST OF GRAPEVIEW BOULEVARD, WEST OF BAY HILL DRIVE, AND SOUTH OF BEELINE HIGHWAY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.
IX. a. RESOLUTION 28, 2021 – APPROVING THE DESIGN, SURVEY, AND PERMITTING SERVICES FOR A WESTBOUND RIGHT TURN LANE IMPROVEMENT. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM BEACH GARDENS, FLORIDA, APPROVING THE DESIGN, SURVEY, AND PERMITTING SERVICES RELATED TO PROVIDING A WESTBOUND RIGHT-TURN LANE ROADWAY IMPROVEMENT AT NORTHLAKE BOULEVARD AND OSPREY ISLES BOULEVARD AS PART OF THE NEIGHBORHOOD IMPROVEMENT ASSESSMENT PROGRAM (NIAP); AUTHORIZING THE NECESSARY EXPENDITURE OF FUNDS TO PAY FOR THE DESIGN, SURVEY, AND PERMITTING SERVICES NEEDED TO CREATE ESTIMATES FOR THE NIAP; AUTHORIZING THE CITY MANAGER TO TAKE ALL ACTION NECESSARY TO EFFECTUATE SERVICES FOR THE IMPROVEMENTS; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.
