IT'S KIND OF WEIRD, BUT I'M HERE TONIGHT BECAUSE IN THE PAST SEVERAL MONTHS, SINCE MY FINAL ALLOWABLE TERM ON COUNCIL ENDED, I REALIZED THAT I HAVE SO MUCH MORE THAT I WANT TO DO TO SUPPORT THE WORK THAT YOU ALL DO TO MAKE LIFE BETTER FOR OUR RESIDENTS AND THE WORK THAT ELECTED OFFICIALS IN OUR NEIGHBORING CITIES AND TOWNS AND VILLAGES DO FOR THEIR RESIDENTS AS WELL.

SO I'M EXCITED TO ANNOUNCE THAT I AM NOW AN OFFICIAL CANDIDATE FOR FLORIDA STATE HOUSE DISTRICT 94.

THE SEAT THAT REPRESENTATIVE ROTH WILL BE TERMED OUT OF IN NOVEMBER OF 2024.

AND THAT REPRESENTS PORTIONS OF OUR GREAT CITY WEST OF THE TURNPIKE, INCLUDING ALL OF THE GROWTH DOWN NORTH LAKE, PARTS OF JUPITER, ROYAL PALM BEACH, THE ACREAGE WEST PALM BEACH AND THE WESTERN LAKE COMMUNITIES OF BELLE GLADE, SOUTH BAY AND PAHOKEE.

I AM LOOKING FORWARD TO BRINGING COMMON SENSE AND FORWARD THINKING AND THE EXCEPTIONAL GOVERNMENTAL PRINCIPLES THAT I LEARNED FROM RON, OUR ADMINISTRATION AND OUR STAFF WHILE ON THE CITY COUNCIL BRING THEM TO TALLAHASSEE BECAUSE HEAVEN KNOWS THEY NEED IT.

YOU CAN BE SURE THAT SMART, SUSTAINABLE GROWTH AND MOBILITY, EXPANDING HEALTH CARE ACCESS, SAFE COMMUNITIES, SUPPORT FOR OUR SCHOOLS AND LOCAL BUSINESSES AS WELL AS SOLVING OUR INSURANCE WORKFORCE AND AFFORDABLE HOUSING CRISES ALONG WITH CHAMPIONING HOME RULE RIGHTS, WILL BE MY TOP PRIORITIES.

A ONE SIZE FITS ALL MENTALITY DOES NOT WORK IN THE BEST INTERESTS OF OUR COMMUNITIES.

SO WHEREAS THE CITY OF PALM BEACH GARDENS LOST AN ESTEEMED PUBLIC SERVANT AND FRIEND OF OUR COMMUNITY WITH THE PASSING OF KENNETH PAUL BERGQUIST, JR ON WEDNESDAY, JUNE 7TH.

BORN IN WASHINGTON, DC, HE GREW UP IN A MILITARY FAMILY AND ATTENDED THE UNITED STATES NAVAL ACADEMY BEFORE TRANSFERRING TO STANFORD UNIVERSITY, GRADUATING WITH A BACHELOR OF ARTS DEGREE IN 1967.

WHILE IN THE UNITED STATES ARMY UNTIL 1974, PAUL KENNETH PAUL BERGQUIST JR WAS AWARDED THE SILVER STAR, SIX BRONZE STARS, TWO PURPLE HEARTS AND THE COMBAT INFANTRY BADGE FOR HIS SERVICE IN THE VIETNAM WAR AND REMAINING A MEMBER OF THE UNITED STATES ARMY RESERVE.

HE RECEIVED HIS J.D., HIS JURIS DOCTORATE DEGREE FROM THE UNIVERSITY OF TEXAS LAW, AND JOINED THE CENTRAL INTELLIGENCE AGENCY, CIA, AND THEN, FOLLOWING HIS SERVICE IN THE CIA, HE WAS THEN HONORED TO SERVE AS CHIEF COUNSEL AND STAFF DIRECTOR OF THE SENATE'S VETERANS AFFAIR COMMITTEE UNDER SENATOR ALAN SIMPSON OF WYOMING.

AND IN 1983, BERGQUIST BECAME THE DEPUTY ASSISTANT SECRETARY FOR READINESS, FORCE MANAGEMENT AND TRAINING IN THE UNITED STATES DEPARTMENT OF THE ARMY.

IN 1986, HE BECAME DEPUTY ASSISTANT ATTORNEY GENERAL IN THE UNITED STATES DEPARTMENT OF JUSTICE'S OFFICE OF LEGISLATIVE AFFAIRS.

AND UNDER PRESIDENT RONALD REAGAN, BERGQUIST WAS APPOINTED AS DEPUTY ASSISTANT SECRETARY OF THE ARMY MANPOWER AND RESERVE AFFAIRS, DEPUTY ASSISTANT ATTORNEY GENERAL, LEGISLATIVE AFFAIRS AND ASSISTANT SECRETARY OF THE NAVY, MANPOWER AND RESERVE AFFAIRS.

AND THEN, FOLLOWING THE TERRORIST ATTACKS ON OUR COUNTRY ON SEPTEMBER 11TH, 2001, HE WAS ASSIGNED TO THE UNITED STATES CENTRAL COMMAND AS SPECIAL OPERATIONS STAFF DIRECTOR FOR OPERATION ENDURING FREEDOM AND OVERSAW UNCONVENTIONAL WARFARE AND SPECIAL OPERATIONS DURING THE AFGHANISTAN WAR AND THEN RETIRING FROM 35 YEARS OF ACTIVE AND RESERVE DUTY.

HE CONTINUED TO CONTRIBUTE TO THE GOALS OF THE UNITED STATES FOREIGN POLICY AND MILITARY INTERESTS AND EFFORTLESSLY WORKED FOR OTHERS WITH HIS FRIENDS AND FAMILY LAW PRACTICE AND OFFERING CONSISTENT AND GENEROUS PRO BONO ASSISTANCE.

SO IT IS MY PLEASURE.

SO THE PROPERTY WE'RE DISCUSSING TONIGHT IS LOCATED RIGHT ACROSS FROM YOUR GOLF COURSE ON THE SOUTH SIDE OF NORTH LAKE BOULEVARD.

GENERALLY, IT'S ACROSS FROM THE GOLF COURSE, RIGHT BEHIND IT TO THE SOUTH, WHERE YOU SEE SINGLE FAMILY RESIDENTIAL IS THE RUSTIC LAKES COMMUNITY.

AND THEN EAST IS THE ENTRY TO BAY HILL AND THEN BAY HILL ESTATES.

AND THE PRESERVE AT BAY HILL IS IN THE BACK SIDE OF THAT AS WELL.

IT IS IN THE VICINITY OF IBIS AVENIR AND THE SOON TO BE EXPANDED CEMETERY, WHICH HAD PREVIOUSLY BEEN APPROVED FOR A MEDICAL TYPE USE, LET'S CALL IT IT IS NOW THAT IS NOW GONE, AND IT WILL BE EXPANDED WITH SIZE APPROVAL OF THE EXPANSION OF THE CEMETERY THERE. SO YOU DO HAVE SEVERAL APPLICATIONS BEFORE YOU TONIGHT.

AND MAX WILL WALK THROUGH SOME OF THE SPECIFICS, A LITTLE BIT OF EACH.

THERE IS A FUTURE LAND USE AMENDMENT TO RESIDENTIAL MEDIUM.

I'M GOING TO EXPLAIN. THIS IS LESS THAN OUR INITIAL REQUEST.

THE OTHERS WERE LOOKING AT A REZONING TO A PUD, A SITE PLAN FOR 111 TOWNHOMES.

AGAIN, THIS IS LESS THAN OUR INITIAL REQUEST.

I'LL WALK THROUGH THAT IN JUST A SECOND.

AND WAIVERS THAT ARE REALLY NECESSARY FOR ANY TOWNHOME DEVELOPMENT IN THE CITY OF PALM BEACH GARDENS BECAUSE YOU DON'T HAVE TOWNHOME REGULATIONS IN THE CODE.

SO ANY TOWNHOME DEVELOPMENT NEEDS TO DEAL WITH THESE.

AND I THINK IN THE STAFF REPORT, IT LAYS OUT VERY SIMPLY AND CLEANLY.

I THINK ALL BUT ONE ARE BASICALLY JUST A FUNCTION OF THE FACT THAT THE TOWNHOMES ARE NEEDED TO TO HAVE THOSE WAIVERS AND THEY WERE GIVEN TO OTHER TOWNHOMES

IN THE CITY. SO ALTHOUGH THIS IS A VACANT SITE, THERE'S A LOT OF HISTORY TO IT.

THERE IS AN EXISTING APPROVAL THAT WILL GO AWAY WITH THIS APPROVAL.

SO IF THESE APPLICATIONS ARE APPROVED, WHAT IS THERE NOW WILL BE GONE BY APPROVAL.

IT IS A VACANT SITE, BUT IT IS APPROVED FOR DEVELOPMENT.

THEY COULD THEORETICALLY GO GET THEIR NEW TRAFFIC UPDATE AND BEGIN CONSTRUCTION SHOVEL READY, READY TO GO.

THE SITE PLAN IS APPROVED AND IN PLACE THERE.

SO JUST A BRIEF THIS IS JUST A BRIEF HISTORY THAT'S ON THE SCREEN THERE OF SOME OF THE REGULATORY MATTERS THAT EXISTS FOR THE SITE.

BUT IMPORTANTLY, AS THE EXISTING APPROVAL, THIS IS WHAT THE SITE COULD BE BUILT FOR.

RIGHT NOW, 42,819FT² OF MEDICAL OFFICE USE.

THERE IS A FUTURE DEVELOPMENT POSSIBILITY ON THE WEST SIDE.

AND IF YOU'RE LOOKING AT COMPATIBILITY, THE PROPER USE IN THAT CASE WOULD BE MORE MEDICAL OFFICE OR SOME PROFESSIONAL OFFICE, WHICH I ONLY MENTIONED BECAUSE THOSE ARE HIGH GENERATING TRAFFIC USES PARTICULARLY.

AND WHAT WE ARE DOING IS TAKING ALL THAT OUT.

AND SO YOU DON'T EVER HAVE TO WORRY ABOUT WHAT MIGHT COME ON THE WEST SIDE.

ALL THE ANALYSIS THAT YOU'RE GOING TO HEAR ABOUT THE BEFORE AND AFTER, WHAT'S EXISTING VERSUS WHAT'S PROPOSED IS REALLY BASED ON JUST THE EAST SIDE OF THE PROPERTY WITHOUT CONSIDERATION OF THE WEST SIDE, WITH ONE EXCEPTION RELATIVE TO THE COMPREHENSIVE PLAN.

BECAUSE OF THE WAY THOSE ANALYZES WORKS, IT ALSO INCLUDED A DIRECT CONNECTION FROM NORTHLAKE TO BAY HILL DRIVE BEHIND THE GATES.

IT'S AN 80 FOOT WIDE RIGHT OF WAY, WHICH IS REFERRED TO AS A COLLECTOR ROAD.

SO IT'S A PRIVATE ROAD, BUT IT WAS DESIGNED TO COLLECT TRAFFIC IN AN 80 FOOT WIDE RIGHT OF WAY IS PRETTY WIDE RIGHT OF WAY.

IT'S NOT JUST A LITTLE TWO LANE ACCESS POINT THAT WAS MEANT TO CONNECT IN, GO THROUGH AND CONNECT BAY HILL DIRECTLY TO NORTH LAKE AT THAT LOCATION THAT WAS APPROVED BY PALM BEACH COUNTY.

YOU ALL HAD NOTHING TO DO WITH THIS, BUT THAT'S WHAT'S THERE.

WITHOUT CONSIDERATION OF ANY FUTURE DEVELOPMENT.

THE GENERATION OF THIS, THE TRIP GENERATION HERE FROM A TRAFFIC PERSPECTIVE, WOULD GENERATE 1341 DAILY TRIPS.

THIS IS ALL FROM THE EXISTING APPROVAL FROM PALM BEACH COUNTY.

SO DOCTOR ORTEGA DID SOME COMPARISONS.

HE COMPARED THE TRAFFIC FROM THE EXISTING APPROVED DEVELOPMENT TO THE PROPOSED DEVELOPMENT AS IT IS NOW, NOT WHAT IT WAS, BUT WHAT WE HAVE NOW.

THIS SHOWS THAT THE EXISTING PLAN THAT IS CURRENTLY APPROVED WOULD HAVE 524 MORE TRIPS ON THE ROADS EVERY DAY THAN WOULD OCCUR AS A RESULT OF THE TOWNHOMES THAT ARE BEING PROPOSED TONIGHT.

AND IF YOU CONSIDER A MAXIMUM OFFICE DEVELOPMENT FOR THE SITE, YOU ARE ACTUALLY LOOKING AT MORE THAN 3500 TRIPS THAT WOULD BE ASSOCIATED WITH THAT DEVELOPMENT.

AGAIN, I UNDERSTAND NOT ALL OF THAT IS APPROVED, BUT YOU CAN'T ASSUME THAT THAT PARCEL WOULD BE VACANT FOREVER.

SOMETHING GETS TO GO THERE.

IT JUST BECOMES A MATTER OF WHAT.

AND SO ALL OF THAT COULD BE FAR WORSE IN TRAFFIC THAN WHAT WE'RE TALKING ABOUT TONIGHT.

THE EXISTING PROJECT AS IT IS, WOULD HAVE 13 U-TURNS IN THE MORNING, 59 U-TURNS IN THE PM.

SO THOSE ARE THE TWO HOUR RANGES.

WHEN YOU LOOK AT AM AND PM PEAK FOR TRAFFIC, WHICH IS WHAT THE COUNTY CODE REQUIRES, THAT'S WHAT ALL THE CODES REQUIRE.

YOU LOOK AT THE PEAK TRAFFIC WHEN MOST PEOPLE ARE ON THE ROAD.

THAT COMPARES TO THE PROPOSAL WHICH IS 16IN THE AM AND NINE IN THE PM.

SO IF YOU THINK ABOUT THAT, WE'RE TALKING ABOUT ALMOST A 50 U-TURN REDUCTION FROM CURRENT APPROVAL ALONE WITHOUT CONSIDERATION OF THE WEST SIDE TO WHAT IS PROPOSED TONIGHT IN U-TURNS FOR PEOPLE WHO WOULD ULTIMATELY HAVE TO GO OUT AND COME BACK THE OTHER WAY.

SO THIS IS THIS HAS BEEN GOING ON FOR A WHILE.

SO WE FIRST CAME IN HERE WHAT IS NOW MORE THAN TWO YEARS AGO, I DIDN'T HAVE A BEARD.

WHEN WE STARTED THIS, I PROBABLY WEIGHED A LITTLE LESS.

SO WE WON'T TALK ABOUT THAT.

BUT TWO YEARS AGO, WE'VE HAD A LOT OF CHANGES FROM THAT AND IT'S A RESULT OF A NUMBER OF THINGS.

THE DRAMATIC CHANGES YOU'RE GOING TO SEE FROM THIS PLAN THAT WAS DOCTORS FIRST INITIAL PROPOSAL AS A RESULT OF TWO PRIMARY FACTORS.

ONE IS SITTING TO THE RIGHT, THIS YOUR STAFF, AND THE OTHER IS THE FOLKS AT RUSTIC LAKES AND THE BOARD AND THEIR ATTORNEY, WHO WE SPENT A LOT OF TIME WORKING WITH, NOT JUST MEETINGS, PHONE CALLS, EMAILS BACK AND FORTH, LOOKING AT THINGS, PLAN CHANGES A LOT THAT GOES INTO THAT.

SO THE INITIAL PROPOSAL IS FOR WAS HIGH RESIDENTIAL.

AGAIN, AS I SAID, WE'RE ASKING FOR MEDIUM DENSITY RESIDENTIAL.

THE INITIAL PROPOSAL WAS HIGH DENSITY RESIDENTIAL, ALL 186 TOWNHOMES, WHICH WOULD BE 10.4 UNITS PER ACRE.

YOU CAN ALSO SEE IT HAD LONG RUNS OF ROADWAY.

IN ORDER TO MAKE THIS WORK, YOU JUST HAD THESE LONG RUNS ROADS DEAD ENDED, YOU KNOW, NOT A LOT OF NOT A LOT OF COLOR AND PICTURE TO IT.

THERE WASN'T A LOT TO IT.

WE WERE TOLD VERY QUICKLY BY YOUR STAFF, THAT AIN'T HAPPENING.

RIGHT. WE DON'T EVEN NEED TO HEAR FROM ANYBODY ELSE.

WE WERE TOLD THAT AIN'T HAPPENING.

BUT IT'S IMPORTANT THAT YOU UNDERSTAND THIS PROCESS TO GET TO WHERE WE ARE BECAUSE IT'S NOT LIKE WE JUST WALKED IN HERE AND ARE GETTING EVERYTHING WE WANT.

IN FACT, QUITE THE OPPOSITE.

SO WE WENT BACK TO THE DRAWING BOARD A LITTLE BIT, DROPPED IT DOWN TO 8.2 UNITS PER ACRE.

A FEW MONTHS LATER WITH 148 STILL HAD THE RESIDENTIAL HIGH LAND USE, HAD THE ZONING THAT WOULD HAVE RESULTED IN ABOUT 1000 TRIPS, A LITTLE OVER 1000 TRIPS PER DAY.

STILL HAD A LOT OF THOSE UNITS THAT BACKED UP TO NORTH LAKE.

YOU HAD A LOT OF THOSE LONG RUNS OF ROADWAYS AND DEAD ENDS.

AND SO WE HAD TO GO BACK TO THE DRAWING BOARD YET AGAIN.

AND HERE'S HOW THAT HAPPENED.

FROM FEBRUARY OF 2021 UNTIL WE ARE HERE TODAY, THIS IS A NUMBER OF MEETINGS THAT HAVE OCCURRED.

IT'S NOT EVERY MEETING BECAUSE EVERY DRC OR MEETING EVERY TIME WE MET WITH STAFF, EVERY TIME WE MET WITH RUSTIC LAKES OR HAD A CONVERSATION ISN'T HERE.

THERE'S A LOT THAT GOES INTO IT.

BUT THERE WAS AN ITERATIVE PROCESS.

THERE WAS A LOT OF DISCUSSION WITH MR. BARNES, WHO WAS THERE AND THE FOLKS FROM BAY HILL PRESERVE.

AND THEN ON MONDAY NIGHT, I WAS I HAD THE PLEASURE OF ATTENDING A MEETING WITH CARLTON OAKS.

WE HAD ABOUT, I THINK, NINE OR SO PEOPLE.

AND VICTOR, THANK YOU FOR PUTTING IT TOGETHER.

THE CITY HAS TAKEN IT OFF THE PLANS.

WE'VE REMOVED THAT. IT'S NOT SOMETHING YOU SEE ANYWHERE.

WORKING WITH TODD AND KATHY, YOUR ENGINEERING DEPARTMENT, WORKING WITH PLANNING AND ZONING PARTS, REALLY COMING COLLABORATIVELY, WORKING TOGETHER TO GET THIS DONE.

THERE'S BEEN, OF COURSE, A LOT OF ANNEXATION IN THE WESTERN PART OF THE CITY, INCLUDING THIS PROPERTY AND RUSTIC LAKES.

THERE'S BEEN RECENT ANNEXATION FURTHER TO THE WEST ON NORTH LAKE BOULEVARD, WHICH OF COURSE THERE'S BEEN INCREASED DEVELOPMENT PRESSURE AND INCREASED EMPLOYMENT OPPORTUNITIES IN THE WESTERN PART OF THE CITY, SPURRED MOSTLY BY AVANIR, OF COURSE, WHICH WE ALL KNOW.

AVANIR HAS A LOT OF RESIDENTIAL UNITS, BUT IT ALSO HAS 400,000FT² OF COMMERCIAL THAT'S PLANNED FOR AND ALMOST 2,000,000FT² OF OF OFFICE SPACE.

SO THERE'S A NEED FOR A DIVERSIFIED HOUSING STOCK IN THE WESTERN PART OF THE CITY.

AND OF COURSE, WE KNOW JUST IN GENERAL, NOT JUST IN THE CITY, BUT ALSO IN THE COUNTY, THAT THERE'S A CONTINUED NEED FOR FOR MORE HOUSING.

AND REALLY, OTHER THAN THE 250 TOWNHOMES THAT ARE IN AVANIR, THERE ARE NO NEW TOWNHOMES THAT ARE WEST OF THE BEELINE HIGHWAY, WHICH CREATES A LACK OF DIVERSITY OF HOUSING TYPES. NOT EVERYONE WANTS A SINGLE FAMILY HOME.

WHEN YOU HAVE A DIVERSIFIED HOUSING STOCK, THAT REALLY STRENGTHENS THE ABILITY FOR PEOPLE TO FIND HOUSING TYPES THAT ARE SUITABLE TO THEM, WHICH THEN ALLEVIATES ANY, YOU KNOW, HOUSING MISMATCH OR SHORTAGE.

YOU KNOW, AND WE ALL KNOW THAT THE CITY IS APPROACHING BUILDOUT.

THERE'S NOT MANY VACANT PIECES OF LAND LEFT.

SO WE CAN'T LET THOSE OPPORTUNITIES SLIP AWAY LIKE THIS ONE WHERE IT'S IT'S TOO SMALL FOR A SINGLE FAMILY DEVELOPMENT.

BUT WE BELIEVE THE MORE APPROPRIATE USE IS FOR A MEDIUM DENSITY RESIDENTIAL USE, AS BRIAN OUTLINED IN THE TRAFFIC REPORT THAT WE'VE DONE FROM A TRAFFIC TRAFFIC PERSPECTIVE.

THE DEVELOPMENT OF THE TOWNHOME DEVELOPMENT IS MUCH MORE COMPATIBLE WITH THE SURROUNDING COMMUNITY THAN THE PROPOSED AND ACTUALLY THE APPROVED COMMERCIAL OFFICE PROJECT IS.

AND LOCATING MEDIUM DENSITY RESIDENTIAL USES ALONG A MAJOR CORRIDOR SUCH AS NORTHLAKE BOULEVARD IS WITH THE LOWER RESIDENTIAL

DENSITIES LOCATED AWAY FROM IT, LIKE IN OUR CASE, TO THE WEST AND TO THE SOUTH.

THAT IS A STANDARD URBAN PLANNING PRINCIPLE.

YOU WANT A TRANSITION DENSITY AWAY FROM THE HIGH USE CORRIDORS.

SO THIS IS THE NEW SITE PLAN THAT WE'VE BEEN ALLUDING TO UP UNTIL NOW.

SO AS YOU CAN SEE, IT'S VASTLY DIFFERENT THAN THE FIRST TWO VERSIONS THAT WE STARTED OFF WITH THE ENTRANCE.

AND I'LL GO INTO MORE DETAIL IN A COUPLE OF OTHER SLIDES THAT ZOOM IN ON THE ON THE ON THE SITE IN A COUPLE OF AREAS.

BUT YOU COME IN OFF OF NORTHLAKE BOULEVARD IN THE MIDDLE OF THE PROPERTY AS YOU COME THROUGH.

IT'S A GATED COMMUNITY. SO YOU COME THROUGH THE GATES, THERE'S A YOU EITHER GO LEFT OR YOU GO RIGHT AND THEN THERE'S FULL CIRCULATION.

THERE'S NO DEAD END STREETS ANYMORE.

IT'S YOU GO YOU GO AROUND THE WHOLE PROPERTY AND YOU COME BACK TO WHERE YOU STARTED.

THERE'S A CENTRALIZED RECREATION AREA IN THE MIDDLE.

SO HERE ARE SOME OF THE KEY DESIGN FEATURES.

BECAUSE IT IS A VACANT SITE, WE HAVE TO EXTEND WATER AND SEWER SERVICE TO THE PROPERTY FROM THE WEST.

SO WE HAVE ACTUALLY 50FT IN TOTAL OF WHAT YOU CAN CALL A BUFFER.

THE FIRST 30FT OF IT, THE NORTHERNMOST 30FT OF IT IS A 30 FOOT WIDE UTILITY EASEMENT WHERE UNDER THE GROUND THERE WILL BE THE WATER MAIN AND SEWER MAIN EXTENSIONS. SO WE CAN'T PLANT TREES IN THE WATER AND SEWER EASEMENT, BUT WE CAN HAVE SIDEWALKS AND LOW, LOW COVER GROUND COVER.

SO AND THEN BEHIND THAT, 30FT IS THE OFFICIAL 20 FOOT LANDSCAPE BUFFER WHERE WE WILL HAVE A SIX FOOT WALL ON TOP OF A 2.5FT BERM.

SO THAT'S EIGHT FEET, 8.5FT OF OPAQUE WALL BUFFER IN THE MIDDLE OF THAT BUFFER.

AND THEN ON BOTH SIDES OF IT, THERE'LL BE VARYING AMOUNTS OF LANDSCAPING AT DIFFERENT HEIGHTS AND OF COURSE, GROUND COVER WITH SHRUBS.

AND I HAVE SOME RENDERINGS LATER THAT WILL DETAIL EXACTLY WHAT YOU WOULD SEE FROM NORTH LAKE AS YOU'RE DRIVING ALONG THERE.

ALSO, THERE IS AN EIGHT FOOT WIDE SIDEWALK THAT WE'RE PROPOSING TO MEANDER THROUGH THAT THROUGH THAT UTILITY EASEMENT.

AS I MENTIONED, THE PROPERTY IS GATED.

THERE'S A CALL BOX WHERE GUESTS WILL BE RUNG IN THROUGH THE THROUGH THE CALL BOX.

RESIDENTS WILL HAVE THE BAR CODE ON THEIR ON THEIR CARD, WHICH WILL AUTOMATICALLY LET THEM THROUGH THE GATE.

SO FOR WESTBOUND TRAFFIC ON NORTH LAKE, WE ARE PROPOSING A NEW LEFT TURN LANE INTO THE PROJECT.

AND FOR EASTBOUND TRAFFIC WE ARE PROPOSING A RIGHT TURN LANE.

AND THEN SO IN ORDER TO PREVENT LEFT TURNS OUT OF THE PROJECT, WE ARE GOING TO BUILD WHAT IS COMMONLY REFERRED TO AS A PEANUT OR A PORK CHOP, WHERE IT'S A CONCRETE IT'S A CURVED CONCRETE IMPROVEMENT THAT PREVENTS THAT PERSON FROM MAKING A LEFT OUT OF THE PROJECT.

WE'RE ALSO PROVIDING A SCHOOL BUS SHELTER AT THE EXIT POINT OF THE COMMUNITY SO THAT ANY SCHOOL CHILDREN THAT LIVE IN THE COMMUNITY CAN CAN BE PICKED UP HERE BY THE SCHOOL BUS. NOW WE'RE KIND OF SHIFTING TOWARDS THE SOUTH END OF THE PROJECT.

AS I MENTIONED BEFORE, THERE IS A CENTRALIZED RECREATION AREA.

THERE'S A CLUBHOUSE OF ABOUT 3200FT², A TOT LOT AND A POOL.

THE RECREATION AREA IS CONNECTED TO THE REST OF THE PROJECT THROUGH SIDEWALKS, THOSE YELLOW SIDEWALKS THAT YOU SEE ON THIS SLIDE.

CONNECT OUTWARDLY TO THE REST OF THE SIDEWALKS.

IN TOTAL, THERE ARE JUST OVER TWO MILES OF SIDEWALKS IN THE PROJECT.

THEN STAYING AT THE SOUTH END OF THE PROJECT.

AS BRIAN MENTIONED BEFORE, ONE OF THE THINGS WE AGREED TO WITH RUSTIC LAKES WAS INCREASING THE HEIGHT OF THE WALL IN THE SOUTH BUFFER FROM SIX FEET TO 7.5FT, WHICH IS ON TOP OF A 2.5FT BERM.

SO THAT'S A TEN FOOT OPAQUE BUFFER ALONG THE SOUTH PROPERTY LINE.

THE WALL DOES, THOUGH, IN FACT, GO AROUND THE ENTIRE PROPERTY.

IT TURNS INTO A FENCE AT THE MAIN ENTRANCE, BUT IT GOES AROUND THE ENTIRE PROPERTY.

SO IT'S A TOTALLY SECURE SITE.

AND THE BUFFERS ON THE EAST, WEST AND SOUTH SIDE BY CODE ONLY HAD TO BE EIGHT FEET WIDE.

ON THE SOUTH SIDE, WE ALMOST TRIPLED THAT TO 25FT IN WIDTH IN ORDER TO GIVE AGAIN, A MORE A DEEP LANDSCAPE BUFFER NEXT TO RUSTIC LAKES. AND THEN ON THE EAST AND THE WEST SIDE ON THE EAST SIDE IS 12.5FT ON THE WEST SIDE.

IT STARTS AT 12.5FT AT THE NORTH END.

THEN IT KIND OF WIDENS OUT TO 18FT AT THE SOUTH END OF THE WEST BUFFER AND AGAIN, THERE'S NO HOMES BACKING UP TO RUSTIC LAKES.

THERE'S ALSO NO HOMES THAT BACK UP TO NORTH LAKE BOULEVARD THAT IN OUR FIRST COUPLE OF VERSIONS, NORTH LAKE BOULEVARD, WHICH 98% OF THE PEOPLE IN

THESE ARE ALL WHAT YOU WOULD CALL STANDARD WAIVERS FOR A TOWNHOME PROJECT BECAUSE AGAIN, YOUR CODE DOESN'T REALLY CONTEMPLATE A TOWNHOUSE PRODUCT IN IT.

IT'S ACTUALLY A BETTER SITUATION FOR THE CITY THAT YOU REQUIRE THESE WAIVERS BECAUSE IT REQUIRES THE DEVELOPER TO GO ABOVE AND BEYOND YOUR CODE TO DEMONSTRATE THAT THESE WAIVERS ARE JUSTIFIABLE.

BUT JUST TO GIVE YOU AN EXAMPLE, I MEAN, OBVIOUSLY AN ATTACHED TOWNHOME CANNOT HAVE A SIDE SETBACK OF TEN FEET.

SO LIDAR AND ITS VERY SIMPLEST FORM IS A IS A LASER THAT SHOOTS OUT FROM A PIECE OF EQUIPMENT.

IT GOES OUT, IT BOUNCES OFF EVERYTHING THAT THAT IS EXISTING.

IT COMES BACK TO THE PIECE OF EQUIPMENT AND IT CREATES A 3D MODEL DOWN TO THE SPECIFICITY OF EVERY LEAF ON EVERY TREE, RIGHT? AND THEN WE BUILD THAT MODEL IN IN OUR SYSTEM, AND THEN WE SHARE THAT MODEL.

WE'VE ALREADY TALKED ABOUT THE THE SITE PLAN THAT'S ALREADY EXISTING ON SITE.

WHEN THE STAFF IS REVIEWING A LAND USE CHANGE TO THE COMPREHENSIVE PLAN STAFF LOOKS AT TWO THINGS,

PRIMARILY COMPATIBILITY, BOTH WITH THE COMPREHENSIVE PLAN AND WITH THE NEIGHBORING THE SURROUNDING PROPERTIES AND ALSO THE LEVELS OF SERVICE STANDARDS THAT ARE ESTABLISHED WITHIN OUR CODE. AND SO I'LL BRIEFLY DISCUSS THOSE.

WE HAVE FOUR PARCELS IN THE PROJECT.

THE TWO ON THE EASTERNMOST ARE CURRENTLY HAVE A COMMERCIAL LAND USE.

THIS IS WHERE THE MEDICAL OFFICE BUILDINGS WERE APPROVED ON THE SITE AND TO THE ON THE TWO WESTERNMOST ARE ASSIGNED A RURAL RESIDENTIAL.

THE APPLICANT IS REQUESTING TO HAVE ALL FOUR PARCELS OR 17.89 ACRES AS RESIDENTIAL MEDIUM.

RESIDENTIAL MEDIUM IS.

IT SERVES A LOT OF FUNCTIONS, BUT ONE OF THOSE IS AS THAT TRANSITIONAL LAND USE BETWEEN LOWER DENSITY USES AND MORE INTENSE LAND USES SUCH AS COMMERCIAL OR INDUSTRIAL OR IN THIS CASE, A HIGH TRAFFIC THOROUGHFARE.

IT'S ALSO INTENDED TO BE LOCATED IN AREAS WHERE THE CITY SERVICES SUCH AS WATER, POLICE AND FIRE AND CAN BE PROVIDED IN AN ECONOMICAL AND EFFICIENT MANNER.

AND IT'S ALSO INTENDED TO PROVIDE A VARIETY OF HOUSING OPTIONS.

SO THIS THE RESIDENTIAL MEDIUM LAND USE IS CONSISTENT WITH THE COMPREHENSIVE PLAN.

WE LOOK AT THE THE LEVELS OF SERVICE FOR THE PROJECT, IN THIS CASE FOR TRAFFIC.

ONE OF THE PRIMARY THINGS THAT IS OF INTEREST THE WITH THE APPROVED LAND USES THE PROJECT HAS A POTENTIAL OF UP TO 4300 DAILY TRIPS ON NORTH LAKE WITH THE PROPOSED RESIDENTIAL MEDIUM THAT WOULD REDUCE THE TRAFFIC BY OVER 3500 TRIPS ON A DAILY BASIS. IT MEETS ALL THE LEVELS OF SERVICE STANDARDS FOR POLICE, FIRE, RESCUE, DRAINAGE, WATER AND WASTEWATER AND ALSO SOLID WASTE.

WE ALSO LOOKED AT WHETHER OR NOT THIS THE RESIDENTIAL MEDIUM, IS COMPATIBLE WITH THE SURROUNDING PROPERTIES.

THE SUBJECT PROPERTY IS SHOWN IN ORANGE ABOVE THE LOW DENSITY OF RUSTIC LAKES, AND ON THE NORTH IS THE HIGH TRAFFIC THOROUGHFARE OF NORTH LAKE. THERE IS RESIDENTIAL MEDIUM ALREADY IN THE AREA.

IBIS ACTUALLY HAS A RESIDENTIAL MEDIUM, WEST PALM BEACH LAND USE AND THERE'S ALSO BEEN RESIDENTIAL MEDIUM APPROVED THROUGH THE TOWNHOMES IN AVENIR TO THE WEST.

THERE'S ALSO A SIGNIFICANT COMMERCIAL DEVELOPMENT EITHER CURRENTLY EXISTING OR APPROVED ALONG THE CORRIDOR, BOTH AT THE SHOPPES, AT IBIS TO THE EAST AND ALSO THE AVENIR TOWN CENTER AND THE THE TWO COMMERCIAL DEVELOPMENTS ON EITHER SIDE OF COCONUT BOULEVARD RECENTLY ANNEXED INTO THE CITY.

SO WE FEEL THAT THE RESIDENTIAL MEDIUM IS COMPATIBLE WITH THE NEARBY DEVELOPMENT AND THE THE RESIDENTIAL MEDIUM MEETS THE FINDINGS OF FACT REQUIREMENT REQUIRED FOR APPROVAL FOR FOR THE PROPOSED LAND USE.

MOVING ON TO THE REZONING ANALYSIS, AGAIN, THE TWO EASTERNMOST PARCELS CURRENTLY HAVE A PUD OVERLAY WITH AN UNDERLYING PROFESSIONAL OFFICE WHICH ALLOWS THE APPLICANT OR THE OWNER TO MAINTAIN THE EXISTING USES THAT ARE APPROVED THROUGH THE COUNTY AND THE TWO TWO PARCELS TO THE WEST HAVE THE RESIDENTIAL LAND USE OR ZONING.

THE APPLICANT IS REQUESTING A PUD OVERLAY FOR THE ENTIRE 17.89 ACRES WITH AN UNDERLYING RESIDENTIAL MEDIUM WITH THE SITE PLAN APPROVAL. THE APPLICANT HAS GONE OVER THE THE SITE PLAN IN GREAT DETAIL.

I WILL POINT OUT THAT THEY'RE THE APPLICANT IS ALSO PROVIDING LATERAL PLANTINGS IN BOTH OF THE LAKES ON EITHER SIDE AND FOCAL POINT PLANTINGS AS WELL.

AND YOU'LL NOTICE IN THESE AREAS IN BLUE ARE DISPERSED ON STREET PARKING FOR GUEST PARKING THROUGHOUT THE PROJECT.

THE ENTRYWAY, AS THE APPLICANT MENTIONED, WE HAVE THE THE SCHOOL BUS SHELTER AND THE MONUMENT SIGN.

I WILL NOTE THAT THE ONE CHANGE TO THE SITE PLAN IS A CONCEPTUAL RESIDENT TURNAROUND IN THE IN THE ENTRANCE MEDIAN TO ALLOW FOR RESIDENTS IF THEY DROPPED THEIR KIDS OFF AT THE SCHOOL BUS OR IF THEY CHANGE THEIR MIND AND NEED TO GO BACK INTO THE SITE.

THEY DON'T HAVE TO GO OUT ONTO NORTH LAKE AND ADD THE TRAFFIC THERE.

SO WE'LL BE WORKING WITH THE APPLICANT TO HAVE THAT ADDED TO THE SITE.

THE APPLICANT COVERED THE AMENITIES PROGRAM.

THE CLUBHOUSE ALSO INCLUDES THE MAIL KIOSK AND A FITNESS ROOM.

AND I WILL NOTE THAT THE TOT LOT DOES HAVE A FIXED SHADE STRUCTURE, SO THE KIDS WILL BE PROTECTED THERE AS WELL.

PARKING ON THE SITE.

THE PROJECT REQUIRES 350 PARKING SPACES.

THIS IS ONE SPACE PER BEDROOM PLUS 5% FOR GUEST PARKING.

EACH OF THE TOWNHOMES IS PROVIDING THREE PARKING SPACES, ONE INSIDE A SINGLE CAR GARAGE AND TWO ON THE DRIVEWAY.

AND AS. YOU MENTIONED THE GUEST PARKING IS PROVIDED BOTH THROUGH THE DISPERSED PARKING SPACES IN EACH OF THE FOUR CORNERS AND ALSO AROUND THE THE CLUBHOUSE.

WE ANALYZE THE LEVELS OF SERVICE BASED ON THE ACTUAL PROPOSED PLAN, AND IT DOES MEET ALL OF THE LEVELS OF SERVICE.

I WILL NOTE THAT WATER AND WASTEWATER IS BEING PROVIDED THROUGH THE PALM BEACH COUNTY WATER UTILITIES DEPARTMENT AS OPPOSED TO SEACOAST.

SO THERE WAS SOME ADDITIONAL COORDINATION THERE AS WELL.

I WILL MENTION THAT WE'VE THE APPLICANT MENTIONED DRAINAGE AND THE KEEPING THE STORMWATER RUNOFF ON SITE.

THE APPLICANT IS PROVIDING YARD DRAINS BOTH INSIDE AND OUTSIDE OF THE WALL.

SINCE THE WALL IS IS INSIDE OF THE BUFFER, THESE YARD DRAINS WILL HELP KEEP ALL OF THAT THAT STORMWATER RUNOFF ON SITE AND ULTIMATELY EXITING TO THE NORTH.

THE EXISTING DRAINAGE ON NORTH LAKE BOULEVARD.

THIS WILL KEEP ALL THE STORMWATER ON SITE INSTEAD OF GOING INTO THE RUSTIC LAKES AND THE BAY HILL CANALS.

WITH TRAFFIC FOR THE SITE WE ANALYZED BASED ON THE THE PROPOSED LEVEL OF DEVELOPMENT.

WITH THE CURRENT APPROVAL OF 42,000FT² OF MEDICAL OFFICE, THAT'S 1300 DAILY TRIPS.

THE PROPOSED PROJECT WITH 111 DWELLING UNITS WOULD ACTUALLY REDUCE THAT TRAFFIC BY 528.

TRIPS DAILY.

IN ADDITION TO THESE TRIPS, THERE ARE HAVE BEEN SOME RECENT OTHER APPROVALS ON NORTHLAKE BOULEVARD THAT WILL FURTHER REDUCE THE POTENTIAL TRAFFIC.

FIRST, AS MR. SEYMOUR MENTIONED, THE STAR OF DAVID APPROVAL FROM THE CONGREGATE LIVING FACILITY AND THE MEDICAL OFFICE TO A CEMETERY USE WOULD REDUCE TRIPS BY ALMOST 300 DAILY TRIPS.

ADDITIONALLY, PALM BEACH COUNTY RECENTLY APPROVED INITIALLY APPROVED THE REDUCTION IN THE PALM BEACH OR THE INDIAN TRAILS GROVE PROJECT WEST OF THE ACREAGE, REDUCING OVER 1000 SINGLE FAMILY HOMES AND 265 MULTI-FAMILY UNITS.

THIS WOULD RESULT IN A REDUCTION OF ABOUT 14,000 TRIPS, ALL TOLD, BETWEEN THE THREE.

IT WOULD BE 18,000 TRIPS THERE WOULD BE REDUCED.

THE APPLICANT MENTIONED THE TRAFFIC IMPROVEMENTS THAT ARE BEING REQUIRED.

I DID WANT TO TAKE A MOMENT TO ADDRESS SOME OF THE WIDENING PROJECT ON NORTHLAKE BOULEVARD AND THE STATUS OF SOME OF THOSE JUST TO PROVIDE CONTEXT.

AS WE KNOW, SOME NORTHLAKE BOULEVARD IS GOING TO BE WIDENED FROM STATE ROAD SEVEN ALL THE WAY TO SEMINOLE PRATT WHITNEY AS PART OF THE AVANIR PROJECT.

THE SEMINOLE, THE SECTION FROM SEMINOLE PRATT WHITNEY TO 140TH AVENUE, WHICH IS ALSO THE PANTHER NATIONAL BOULEVARD IN AVANIR.

THIS IS THE PALM BEACH COUNTY IS PROVIDING ALL OF THAT AND THOSE ALL OF THEIR RESPONSIBILITY.

AND THAT'S CURRENTLY HAS BEEN DELAYED DUE TO SOME ISSUES FROM 1/40 BOULEVARD TO IVANHOE DRIVE.

THIS PARTICULAR SEGMENT HAS THE SIX LANING HAS BEEN DELAYED DUE TO INCREASED COSTS AND SOME CONTRACTING ISSUES AND ALSO TIMING WITH THE PERMITTING PROCESS.

AND AND THAT'S CURRENTLY OUT FOR BID.

AND FROM ABNER DRIVE TO STATE ROAD SEVEN THAT HAD BEEN STARTED AND THEN WAS DELAYED DUE TO SOME SOME ISSUES WITH UTILITIES AND WITH THE COUNTY AND THAT'S CURRENTLY BACK UNDER CONSTRUCTION AGAIN.

ADDITIONALLY, THERE ARE TWO TRAFFIC SIGNALS THAT ARE CURRENTLY IN PROCESS.

THE FIRST IS THAT NORTHLAKE BOULEVARD AND ABERNATHY DRIVE.

THIS IS UNDER CONSTRUCTION.

IN FACT, THEY THEY JUST POURED THE PYLONS OR POURED THE FOOTERS THIS WEEK.

AND SO THOSE SHOULD BE YOU SHOULD START SEEING MORE CONSTRUCTION IN THAT AREA IN THE COMING MONTHS FROM NORTH NORTHLAKE BOULEVARD AND COCONUT BOULEVARD INTERSECTION AND SIGNAL THAT'S PART OF THE THE CONTRACT THAT IS CURRENTLY BEING DELAYED AND IS IN THE IN THE PERMITTING PROCESS.

THE COCONUT BOULEVARD EXTENSION THAT WE'VE TALKED ABOUT FREQUENTLY AS RECENTLY RECEIVED APPROVAL FOR THE RAILROAD CROSSING AT THE CSX RAILROAD AND TO CONNECT TO THE BEELINE HIGHWAY.

THE CONSTRUCTION PLANS FOR THAT ARE CURRENTLY UNDER REVIEW WITH THE DIFFERENT AGENCIES AND PERMITTING IS ONGOING.

THE APPLICANT DISCUSSED THE ARCHITECTURE, WHICH HAS COME A LONG WAY SINCE THE INITIAL SUBMITTAL.

AS MENTIONED, THERE IS A CONDITION THAT NO TWO BUILDINGS WILL SIDE BY SIDE CAN USE THE SAME ARCHITECTURAL DESIGNS.

I'D ALSO NOTE THAT THERE ARE A VARIETY OF UNIT SIZES FROM 4 TO 7, SO THERE WILL BE ADDITIONAL VARIETY WITHIN THE PROJECT.

WE'VE DISCUSSED THE CLUBHOUSE AND THE TOT LOT, THE STREET TREES.

THE APPLICANT DISCUSSED THE BUFFERS, SO I WON'T GO INTO A LOT OF DETAIL WITH THAT.

I WILL MENTION THAT ON THE SOUTHERN BUFFER AGAINST RUSTIC LAKES.

THE APPLICANT IS RELOCATING A NUMBER OF EXISTING TREES ON SITE INTO THAT BUFFER TO MAINTAIN THOSE.

THE EAST AND WEST BUFFERS ARE OF PARTICULAR INTEREST, PARTICULARLY ON THE WEST, BECAUSE OF THE CONNECTION TO BAY HILL DRIVE.

THE THE APPLICANT IS PROVIDING THE SIX FOOT WALL ON THE BUFFER, ON THE BERM AND PLANTINGS ON EITHER SIDE OF THE OF OF THE WALL IN ORDER TO PROVIDE THAT AN ADDITIONAL BUFFER AND THOSE YARD DRAINS.

AND THE ENTRANCE. I WILL DO WANT TO POINT OUT THAT THE THERE IS THE APPLICANT IS PROVIDING A SIGNATURE LIVE OAK FOR CARLTON OAKS AT JUST TO THE EAST OF THE ENTRANCE.

AND THERE IS A LIFT STATION TO THE EAST OF THE ENTRANCE AS WELL.

THIS IS REQUIRED BY THE PALM BEACH COUNTY WATER UTILITIES DEPARTMENT BECAUSE OF THE NUMBER OF UNITS.

I WILL POINT OUT THAT THEY ALSO DID A LINE OF SIGHT STUDY ON THE SOUTH COMPARED TO THE REST OF LAKE'S NEIGHBORS THAT ARE TO ADJACENT AND THE CLOSEST HOUSE IS OVER 200FT AWAY FROM THE PROPERTY BOUNDARY AND THE PROPERTY BOUNDARY IS 80FT AWAY FROM THE CLOSEST HOUSE AS WELL.

THIS PROJECT HAS HAD A SIGNIFICANT EVOLUTION FROM WHEN IT FIRST CAME IN AS A APPLICATION MEETING IN MARCH OF 21.

THAT'S WHEN IT HAD THE 186 TOWNHOMES SORT OF AS MUCH AS THEY COULD POSSIBLY GET ON THE SITE.

ONE OF THE KEY FACTORS OF THIS BILL IS THAT IT PREEMPTS THE LOCAL GOVERNMENT ON SOME ELEMENTS, SPECIFICALLY WITH DENSITY AND HEIGHT AND ALSO THE PROCESS FOR PROJECTS THAT HAVE AFFORDABLE HOUSING INCLUDED.

I WANT TO POINT OUT THAT FOR THIS PARTICULAR SITE, UNDER THE LIVE LOCAL ACT, IT'S POSSIBLE THAT THE APPLICANT COULD REQUEST UP TO 179 UNITS, WHICH IS TEN UNITS PER ACRE.

THEY COULD DEVELOP UP TO 65FT IN HEIGHT WITH A MIXED USE PROJECT PROVIDING 40% OF AFFORDABLE HOUSING UNITS AS A AS AN ADMINISTRATIVE APPROVAL WITH NO PUBLIC HEARING AND NO PUBLIC NOTICE REQUIRED UNDER THE LIVE LOCAL ACT.

THE APPLICANT DID HAVE WENT THROUGH THE PUBLIC OUTREACH AND ALSO WITH THE LETTERS OF SUPPORT THAT THEY'VE RECEIVED FROM THE IMMEDIATELY ADJOINING PROPERTIES.

THERE ACTUALLY SEEMS TO BE A MESSAGE THAT THE PROJECT WAS CRITICAL IMMEDIATELY TO PROVIDE DIVERSITY HOUSING.

HOWEVER, THERE ARE MANY PLACES IN OUR AREA WHERE THERE SIMPLY IS A GOOD SUPPLY OF AFFORDABLE HOUSING.

PGA RESORT, FOR EXAMPLE.

A LOT OF THEIR HOMES IN THERE ARE PRICED LESS THAN THIS PROPOSED DEVELOPMENT.

ALSO OUTSIDE OF THE CITY, BUT NEARBY WEST LAKE ARTISAN AND ARDEN, RATHER I'M SORRY, IN OTHERS ARE CLEARLY HAVE STARTING PRICES UNDER $500,000.

IS THERE A FURTHER NEED FOR ADDITIONAL MODERATELY PRICED HOUSING IN THE CITY? OF COURSE YOU CAN ARGUE, BUT AS ILLUSTRATED BY THE OPPOSITION, THIS IS SIMPLY NOT THE RIGHT DIRECTION OR THE PROPER TIME FOR THE PROJECT.

THIS IS NOT A NIMBY SITUATION, BUT A PRESSURE POINT THAT REQUIRES MORE ANALYSIS AND SCRUTINY.

ANOTHER ISSUE THAT I WOULD LIKE TO BRING UP TO THE COMMITTEE IS THE CONFUSION AS TO HOW WE ARE HANDLING CITY GROWTH, BE IT THE WIDENING OF NORTH LAKE, THE SR SEVEN PROJECT OR THE CONNECTION TO THE B-LINE.

IT SEEMS THAT THERE ARE MANY UNSETTLED MATTERS AND RELATED TIMING THAT BEGS THE QUESTION OF HOW THE CITY MOVES FORWARD.

THAT UNCERTAINTY QUESTIONS THE TIMING OF ANY NEW DEVELOPMENT IN THE NORTHERN PART OF THE CITY TO BE APPROVED UNTIL THERE IS FINAL RESOLUTION, AN ACCURATE TIMETABLE CAN BE PUT INTO PLACE.

POLICY 1112 EXPLAINS THE TRANSITION BETWEEN RURAL RESIDENTIAL AND A HIGHER DENSITY SHOULD BE

I EXPERIENCED, IN FACT, MYSELF A NEAR ACCIDENT JUST THIS PAST WEEK WHERE MY CAR CAME IN AND THEY CAME IN HERE AND LUCKILY NOTHING HAPPENED FROM VINTAGE OAKS.

THE ONLY TURN IS TO GO EAST ON NORTH LAKE.

WE ARE CERTAINLY NOT AGAINST DEVELOPMENT, AND YOU'RE LIKELY AWARE THAT IN BAYHILL ESTATES COMMUNITY THERE ARE STILL MORE THAN 34 LOTS TO BE DEVELOPED SOON.

POD NUMBER THREE IN YOUR PROJECTS UNDER REVIEW.

EACH OF THESE LOTS IS ONE ACRE IN AREA AND THE ZONING IS LOW, VERY LOW DENSITY.

IT'S NO COINCIDENCE THAT BOTH OF THESE ACCIDENTS HAPPENED IN RUSH HOUR.

THE VOLUME OF AND SPEED OF THE TRAFFIC IS A LETHAL COMBINATION.

SO WHAT CAN WE DO ABOUT IT? WHAT CAN THE CITY DO ABOUT IT? THERE'S NO DOUBT THAT SPEEDS HAVE SOMEWHAT IMPROVED SINCE PALM BEACH GARDENS POLICE STARTED PATROLLING THE AREA.

WE'VE SEEN AN IMPROVEMENT AND THE ADDITIONAL STOPLIGHTS HAVE CREATED BREAKS IN THE TRAFFIC AND WE APPRECIATE WHAT THE CITY HAS DONE.

BUT THE VOLUME IS ONLY GOING TO INCREASE.

A LOT OF TRAFFIC WILL COME FROM THE PALM BEACH GARDENS COMMUNITIES.

WE CAN'T STOP THE INCREASE IN TRAFFIC THAT'S GOING TO COME FROM AVANIR.

THAT SHIP SAILED A LONG TIME AGO.

BUT YOU CAN HELP, ALBEIT IN A SMALL WAY, BY NOT ADDING VINTAGE OAKS TO THE COMMUTERS.

THE THOUSANDS OF COMMUTERS THAT USE NORTHLAKE IN RUSH HOUR TO GET TO WORK AND COME HOME FROM WORK.

MAKE NO MISTAKE, RUSH HOUR TRAFFIC IS THE PROBLEM.

THE PROBLEM THAT D.R.

HORTON CONVENIENTLY IGNORED IN THEIR JUSTIFICATION, THEY CHOSE TO HIGHLIGHT THE WHOLE NUMBER OF TRIPS, DAILY TRIPS.

THAT WAS THE WHOLE THING ABOUT THE JUSTIFICATION ON TRAFFIC.

I HOPE THAT THE AVENUE DEVELOPMENT PLAYS OUT LIKE IT WAS BUILT AND MANY OF THE TRIPS THERE ARE GOING TO STAY WITHIN THE BOUNDARIES OF AVENIR SERVICE WORKERS FOR ALL THE STUFF THAT'S GOING INTO AVENIR, THE COMMERCIAL, THE MEDICAL, THE HOTEL THAT'S GOING TO COME FROM EAST, PROBABLY EAST OF THE BEELINE AND PROBABLY EAST OF MILITARY TRAIL.

SO THEY'RE GOING TO BE MOVING THEIR REVERSE COMMUTING.

THEIR CONCERNS WERE SPECIFIC AND VARIED.

AND FORTUNATELY, WHAT IS INCLUDED IN THE AGENDA TODAY DOES NOT APPEAR TO ASSUAGE THOSE CONCERNS.

I DO AGREE THAT WE NEED HOUSING IN OUR CITY.

HOWEVER, THIS PROPOSAL DOES NOT ADDRESS OUR REAL NEED FOR AFFORDABLE WORKFORCE HOUSING.

FIRST OF ALL, A STARTING PRICE IN THE MID $500,000 FOR A TOWNHOUSE MILES AWAY FROM ANY MAJOR THOROUGHFARES IS NOT A SERIOUS ANSWER TO THIS ISSUE.

SECOND, WE WOULD BE BETTER SERVED INCREASING MULTIFAMILY HOUSING OPTIONS CLOSER TO MAIN LINES OF MOBILITY.

I DO NOT OPPOSE DEVELOPING THIS LOCATION EITHER.

HOWEVER, OTHER USES AND SERVICES, ESPECIALLY MEDICAL OFFICE, ARE NEEDED IN THAT PART OF THE CITY, AND I DISAGREE WITH THE PROPOSED CONTENTION THAT THEY SHOULD ONLY BE IN AVENIR. THIS SPACE IS ALREADY ZONED AND WOULD REQUIRE NO CHANGES BY YOU THE COUNCIL TO ACCOMMODATE.

AND SO IN ADDITION TO PROVIDING FOR OTHER THINGS, ALL OF THE DESIGN CHANGES THAT WE TALKED ABOUT, RIGHT? NO TOWNHOMES TO THE BACK, INCREASED WALLS, BUFFER INCREASES, ADDITIONAL DRAINAGE ELEMENTS TO KEEP THE WATER ON SITE.

THERE IS SOME MONETARY PAYMENT THAT GOES TO THEM BEING ABLE TO FIX SOME OF THE PROBLEMS THAT THEY HAVE.

THIS IS NOT LIKE THIS WENT TO A HUMAN BEING.

ABOUT 95% OF THOSE AGREEMENTS ARE IN WHAT YOU SEE.

BUT EVEN SOME OF WHAT YOU SEE IS IN THE AGREEMENT SO THAT THEY COULD ENFORCE IT, NOT JUST YOU.

AND SO THAT WAS A COMMITMENT OF OUR WORKING THROUGH THE REPRESENTATIVES, AND THAT'S WHY IT'S NOT HIGH DENSITY, IT'S MEDIUM DENSITY.

THAT'S WHY WE DID ALL OF THOSE DESIGN CHANGES.

AND YEAH, WE HOPE RUSTIC LAKES CAN DO SOMETHING WITH THEIR DRAINAGE BECAUSE THEY HAVE MAJOR PROBLEMS WITH THEIR DRAINAGE, HAVING NOTHING TO DO WITH ANYTHING ELSE.

CAN WE TALK A LITTLE ABOUT HOW THAT PROCESS STARTS? HOW DO WE ARE WE BUILDING A WALL? ARE WE PUTTING IN LANDSCAPING? ARE WE DOING ALL THAT IN ADVANCE OF VERTICAL CONSTRUCTION INTERIOR WORK? HERE, I CAN ADDRESS THAT STANDARD CONDITIONS OF APPROVAL FOR VERTICAL THAT THE WALLS AND THE BUFFERS ARE IN PLACE PRIOR TO VERTICAL CONSTRUCTION.

BUT IF THIS WERE TO BE, IN FACT A PROJECT THAT WOULD FALL UNDER LIVE LOCAL ACT AND THEY COULD BUILD 190 UNITS OR WHATEVER IT IS, ARE THEY STILL REQUIRED TO MEET ALL THE CITY GUIDELINES FOR LANDSCAPING TURNS, ALL THAT STUFF THAT WE'RE DOING NOW FOR THIS PARTICULAR PROJECT, OR CAN THEY JUST BUILD WHATEVER THE HELL THEY WANT? THE STATUTE PROVIDES FOR ADMINISTRATIVE PROCESS.

THERE ARE CERTAIN DEVELOPMENT STANDARDS THAT WOULD STILL HAVE TO BE MET, BUT THE HEIGHT AND THE DENSITY CAN BE PROVIDED AT THE TALLEST DENSITY PROVIDED IN THE CITY'S CODE, WHICH IN THIS CASE THE DENSITY IS TEN ACRES PER ACRE, WHICH WOULD PROVIDE 179, AND THE PROPOSAL IS 111.

CDBG. CDBG BACKGROUND.

CDBG WAS ESTABLISHED IN 1974 TO PROVIDE DIRECT FEDERAL BENEFITS TO PRIMARILY BENEFIT LOW TO MODERATE INCOME HOUSEHOLDS AND NEIGHBORHOODS. BEFORE 2015, THE CITY'S ALLOCATIONS OF FUNDS WAS ISSUED DIRECTLY TO PALM BEACH COUNTY.

AND SINCE 2015, WHEN OUR POPULATION HIT 50,000 RESIDENTS.

THE FUNDS COME STRAIGHT TO US NOW, AND WE ARE NOW AN ENTITLEMENT GRANTING COMMUNITY.

WITH BEING AN ENTITLEMENT GRANTEE COMMUNITY OR A CITY, WE ARE REQUIRED TO ADOPT TWO PLANS THE FIRST PLAN BEING OUR CONSOLIDATED PLAN EVERY FIVE YEARS AND THEN OUR ANNUAL ACTION PLAN.

OUR CONSOLIDATED PLAN IDENTIFIES PRIMARY GOALS AND OUR ANNUAL ACTION PLAN SUMMARIZES ACTIONS TAKING PLACE TO MEET THOSE GOALS. WE ARE IN OUR SECOND CONSOLIDATED PLAN, WHICH WAS ADOPTED ON NOVEMBER 5TH, 2020 WITH THE PRIORITY GOAL OF MARY CIRCLE AND DANIELLE DRIVE IDENTIFIED THE WATER LINE PROJECT IDENTIFIED.

THE PROPOSED 2023 ANNUAL ACTION PLAN IS OUR FOURTH ACTION PLAN OF THE 2020 CONSOLIDATED PLAN, AND WE PROPOSE TO CONTINUE TO IMPLEMENT THE MERRY CIRCLE IN DANIA DRIVE WATERLINE PROJECT WITH OUR 2023 ALLOCATION.

MARY CIRCLE AND DANA DRIVE A LITTLE BIT ABOUT THOSE COMMUNITIES.

THEY CURRENTLY USE WELL WATER AND DOES NOT MEET THE FLORIDA HEALTH DEPARTMENT STANDARDS OF 75FT OF SEPARATION BETWEEN THE WELL WATER AND SEPTIC TANKS.

SO WITH THIS NEEDED INFRASTRUCTURE, WE WILL GIVE THE PROPERTY OWNERS THE OPPORTUNITY TO MEET THAT STANDARD.

MARY CIRCLE HAS 46 SINGLE FAMILY HOMES IN DANA DRIVE HAS 32 DUPLEX UNITS ON 16 PARCELS.

THESE NEIGHBORHOODS ARE WITHIN LOW TO MODERATE INCOME BLOCKS, WHICH ALLOW US TO USE THESE FUNDS FOR THIS PROJECT.

MAJOR PROJECT MILESTONES.

SO WE'LL START WITH RIGHT OF WAY ACQUISITION.

MARY'S CIRCLE IS CURRENTLY OWNED BY THE COUNTY AND WE ARE IN FINAL STEPS OF GETTING THAT ROAD.

WE'RE JUST WORKING OUT SOME LEGAL DESCRIPTIONS AND DANIEL DRIVE, WE ARE THE RIGHT OF WAY.

ACQUISITION IS COMPLETE, THE ENVIRONMENTAL REVIEW IS COMPLETE.

NO SUBSTANTIAL IMPACT WAS FOUND WITH THIS PROJECT.

COMMUNITY OUTREACH IS ONGOING AND DOWN BELOW YOU'LL SEE A PICTURE OF PROPERTY OWNERS WITH OUR ENGINEERING DEPARTMENTS TALKING ABOUT AND LEARNING THE PROJECT. AND UP TOP YOU'LL SEE A LETTER THAT WENT OUT TO THE PROPERTY OWNERS AS WELL.

SURVEYING IS COMPLETE, PROJECT DESIGN IS COMPLETE PERMITTING.

OUR PERMITS HAVE BEEN SUBMITTED TO SEA COAST AND ALSO THE PALM BEACH COUNTY HEALTH DEPARTMENT AND THEY ARE CURRENTLY UNDER REVIEW.

THE CONTRACTORS HAVE BEEN ESTABLISHED FOR THIS PROJECT AND DUE TO DANIEL DRIVE, THE RIGHT OF WAY ACQUISITION FOR DANIEL DRIVE BEING COMPLETE, WE ARE LOOKING TO START CONSTRUCTION IN QUARTER THREE OF 2023 WITH A SIX MONTH CONSTRUCTION TIMELINE.

THIS PROJECT HAS BEEN OR THIS THIS ACTION PLAN HAS BEEN PUBLIC HAS IS IN ACCORDANCE WITH OUR CITIZEN PARTICIPATION PLAN AND HAS BEEN ADVERTISED AS SUCH AND STAFF RECOMMENDS APPROVAL.
