I'D LIKE TO THANK EVERYONE WHO IS IN ATTENDANCE.

TODAY IS THURSDAY, OCTOBER 19TH.

THE TIME IS 9 A.M.

AND THIS IS AN IMPACT FEE PUBLIC WORKSHOP.

TO GIVE A LITTLE BIT OF BACKGROUND.

THE PREVIOUS IMPACT UPDATE WAS CONDUCTED IN 2016 AND THE FEES BECAME EFFECTIVE IN 2017.

WE HIRED A CONSULTANT IN 2022 TO PROVIDE AN UPDATE TO OUR IMPACT FEES, AND THE CURRENT PROPOSAL PROPOSES AN UPDATE TO THE METHODOLOGY TO A MORE ACCURATE, PLAN BASED FEE RATHER THAN PAST CONSUMPTION.

THE COST OF CAPITAL IMPROVEMENTS HAS BEEN AFFECTED BY INFLATION.

FEES HAVE BEEN INCREASED, AND THE PURPOSE OF THIS WORKSHOP IS FOR TO EXPLAIN THE FINDING OF EXTRAORDINARY CIRCUMSTANCES WHICH US TO PUBLICLY NOTICED. WORKSHOPS.

THERE IS A SIGN IN SHEET BY THE FRONT DOOR, SO WE PLEASE DO ASK EVERYONE TO SIGN IN.

AND TODAY WE ARE GOING TO BE DISCUSSING THE UPDATE OF PALM BEACH GARDENS, PARK AND RECREATION, FIRE PROTECTION AND EMERGENCY SERVICES, POLICE PROTECTION AND PUBLIC FACILITIES.

UPDATE. AND THEN WE'LL ALSO BE DISCUSSING WHAT IS KNOWN AS EXTRAORDINARY CIRCUMSTANCES, WHICH IS A RECENT CHANGE IN FLORIDA STATUTE.

FOR ANY MEMBERS OF THE PUBLIC.

THIS IS STREAMING.

THAT WANT TO VIEW THE DOCUMENT.

IT'S ACTUALLY A QUITE DETAILED REPORT.

IT'S OVER 300 PAGES, AND IT REALLY SETS FORTH THE LEGAL BASIS FOR THE CITY TO MOVE FORWARD WITH AN UPDATE OF ITS IMPACT FEE.

THAT IS THE ACTUAL LOCATION OF THE DOCUMENT AS OF RIGHT NOW, AND WE'RE COORDINATING WITH CITY STAFF TO MAKE THIS AVAILABLE ON THE THE IMPACT FEE LANDING PAGE.

AND STAY TUNED, AS THERE ALSO WILL BE EVENTUALLY AN EXECUTIVE SUMMARY.

AND AS IT MOVES CLOSER TO ADOPTION, THE ACTUAL IMPACT FEE ORDINANCE ITSELF.

AND SO FOR EVERYTHING I'M GOING TO DISCUSS THIS MORNING IS ACTUALLY MEMORIALIZED IN THIS DOCUMENT.

SO AGAIN, THE UPDATE ITSELF IS LOOKING AT THE PARKS AND RECREATION, FIRE PROTECTION, POLICE PROTECTION AND PUBLIC FACILITIES IMPACT FEE.

THE CITY DOES HAVE A MOBILITY FEE EAST OF THE BEELINE HIGHWAY AND A ROAD IMPACT FEE WEST OF THE BEELINE HIGHWAY.

THOSE WILL BE UPDATED UNDER SEPARATE PROPOSALS.

SO ONE OF THE MAIN DRIVERS OF ANY UPDATE OF AN IMPACT FEE IS GROWTH IN POPULATION AND GROWTH IN EMPLOYMENT.

THE NUMBERS WE LOOKED AT INCLUDE BOTH NATURAL GROWTH WITHIN THE CITY LIMITS ITSELF, AND ALSO THE POTENTIAL FOR GROWTH IN AREAS THAT MAY BE ANNEXED WITHIN THE CITY BETWEEN NOW AND 2035.

AND WE ROUGHLY PROJECT THAT THERE'S GOING TO BE AN ADDITIONAL 32,000 RESIDENTS WITHIN PALM BEACH GARDENS, OR ROUGHLY HALF OF THE EXISTING POPULATION TODAY WILL BE ADDED BY 2035.

SO IT IS FAIRLY SIGNIFICANT GROWTH, AND THIS IS ONE OF THE TOP BASES AND REASONS FOR THE UPDATE AND ALSO FOR THE CLAIM OF EXTRAORDINARY CIRCUMSTANCE. THERE'S ALSO PROJECTED TO BE SIGNIFICANT EMPLOYMENT GROWTH.

PART OF THIS IS AGAIN THROUGH NATURAL DEVELOPMENT WITHIN THE CITY.

PART OF THIS MAY ALSO OCCUR DURING ANNEXATION, BUT THERE'S A POTENTIAL TO ADD ROUGHLY 24,000 EMPLOYEES WITHIN THE CITY.

THIS IS NOT CITY OF PALM BEACH GARDENS EMPLOYEES.

THIS IS A NUMBER OF EMPLOYEES THAT ACTUALLY WORK FOR BOTH PUBLIC AND PRIVATE ENTERPRISES WITHIN THE CITY OF PALM BEACH GARDENS.

IN ORDER TO DEVELOP AN IMPACT FEE THAT'S RELATED TO BOTH RESIDENTIAL LAND USES AND NON RESIDENTIAL LAND USES.

WE DO HAVE TO GO THROUGH A PROCESS KNOWN AS A FUNCTIONAL EQUIVALENT RESIDENT.

IT'S ESSENTIALLY CONVERTING AN EMPLOYEE OF A BUSINESS TO THE EQUIVALENT OF A RESIDENT.

THOSE FOLKS THAT LIVE WITHIN PALM BEACH GARDENS FULL TIME CREATE A DEMAND FOR SERVICES ESSENTIALLY AROUND THE CLOCK FOR POTENTIALLY FOR

FIRE RESCUE, FOR POLICE SERVICES.

AND WHEN OPEN PARKS AND GOVERNMENT EMPLOYEES THAT LIVE AND WORK IN THE CITY ALSO HAVE A SIMILAR IMPACT.

FOR THOSE FOLKS THAT LIVE OUTSIDE OF PALM BEACH GARDENS BUT COMING EACH DAY INTO WORK.

THEY DO HAVE AN IMPACT ON CITY SERVICES, BUT IT'S NOT FULL TIME.

SO ESSENTIALLY WE MAKE ADJUSTMENTS TO THAT TO RECOGNIZE THAT EMPLOYEES THAT DO NOT LIVE IN THE CITY DON'T HAVE THE SAME IMPACT AS RESIDENTS OF THE CITY ITSELF. AND SO THAT GETS US WHAT'S KNOWN AS A FUNCTIONAL EQUIVALENT RESIDENT.

AND REALLY THE NUMBER WE'RE LOOKING AT IS OUT INTO 2035 BECAUSE THIS IS A FORWARD LOOKING IMPACT FEE AND ALSO LOOKING AT THE NEED FOR IMPROVEMENTS TO SERVE THIS GROWTH.

AT THE END OF THE DAY, THE PROJECTION IS TO INCREASE TO ROUGHLY 120,000 FUNCTIONALLY EQUIVALENT RESIDENTS, OR ROUGHLY 45,000 MORE THAN WHAT EXISTS TODAY.

THE UPDATE. THE CITY'S CURRENT COMPREHENSIVE PLAN HAS WHAT'S KNOWN AS A LEVEL OF SERVICE STANDARD, AND IT SORT OF GUIDES WHAT LEVEL OF SERVICES ARE PROVIDED FOR EACH ONE OF THESE VARIOUS FEES.

AND AS YOU SEE, I WILL USE THE TERMS PARK AND RECREATION, BECAUSE THAT'S ACTUALLY A WHOLE SEPARATE DEPARTMENT AND FUNCTION WITHIN THE CITY OF PALM BEACH GARDENS.

THE FIRE, RESCUE AND EMERGENCY SERVICES IS A SEPARATE DEPARTMENT, THE POLICE DEPARTMENT AND IN PUBLIC FACILITIES.

TODAY, IN THE CITY'S COMPREHENSIVE PLAN, THERE A STANDARD OF FIVE ACRES PER 1000 RESIDENTS.

THIS SORT OF HELPS GUIDE THE CITY IN TERMS OF FUTURE PLANNING AND FUTURE.

NEED TO DETERMINE HOW MANY ACRES ARE PROJECTED TO BE NEEDED WITHIN THE COMMUNITY.

FOR FIRE RESCUE.

THE SERVICE STANDARD IS BASED ON RESPONSE TIMES TO CALLS, AND IT DIFFERS WHETHER YOU'RE IN THE PORTION OF THE CITY WE'RE IN TODAY, OR WHETHER YOU'RE IN THE PORTION OF THE CITY WEST OF THE TURNPIKE.

BUT IT'S REALLY IT'S A METRIC.

IT'S SOMETHING THAT THEY USE AS PART OF THEIR ACCREDITATION AND STANDARDS OF HOW QUICKLY THEY CAN RESPOND TO A CALL FOR SERVICE.

FOR THE POLICE DEPARTMENT.

IT'S ALSO CALLS FOR SERVICE.

FOR PUBLIC FACILITIES, THERE IS NO LEVEL OF SERVICE STANDARD, AS YOU'LL SEE THROUGH THIS UPDATE OF THE FEE.

THE FIVE ACRES PER THOUSAND IS A RELATIVELY EASY NUMBER TO QUANTIFY IN TERMS OF DEVELOPING A FEE OR PROJECTING FUTURE NEEDS.

A RESPONSE TIME OR A CALL FOR SERVICE ISN'T REALLY THE BEST METRIC, SO WE'VE ACTUALLY LOOKED AT USING SOME DIFFERENT LEVEL OF SERVICE STANDARDS BASED ON LEVELS OF SERVICE THE CITY HAS BEEN PROVIDING TO USE AN UPDATE OF THE IMPACT FEES.

WE TOOK A LOOK AT SINCE THE CITY.

THEY DO A REALLY GOOD JOB EVERY YEAR AS PART OF THE BUDGET, REPORTING THE SERVICE AND LEVEL OF SERVICE PROVIDED TO CITY RESIDENTS.

BUT IT'S PRIMARILY BASED ON POPULATION AND IT DOES NOT INCLUDE EMPLOYMENT.

SO WE ACTUALLY DID IS WE USED THAT SAME FUNCTIONAL EQUIVALENCY FACTOR, AND WE LOOKED BACK TEN YEARS.

TO WHAT LEVEL OF SERVICE HAS THE CITY BEEN PROVIDING TO BOTH RESIDENTS AND EMPLOYEES WITHIN THE CITY OVER A TEN YEAR PERIOD? WHAT WERE THEY PROVIDING IN 2023 AS PART OF THE BUDGET, AND SHOULD THAT RECOMMEND SOMETHING DIFFERENT MOVING FORWARD FOR PARKS AND RECREATION? THE CITY TODAY IS ACTUALLY PROVIDING 7.32 ACRES PER 1000 EQUIVALENT RESIDENTS, SO THEY'RE ACTUALLY PROVIDING MORE THAN WHAT ITS LEVEL OF SERVICE STANDARD REQUIRES.

AND RECENTLY, I BELIEVE THAT'S A LARGE BUMP OR A LARGE ADDITION, PARTIALLY DUE TO THE AVENIR DEVELOPMENT AND THE WESTERN ANNEXATION AREAS OUT OF THE FAIRLY SIGNIFICANT PORTION OF CITY ACREAGE TO THE OVERALL PARK SYSTEM.

BECAUSE HISTORICALLY THE AVERAGE HAS BEEN ROUGHLY 3.73 ACRES PER 1000 EQUIVALENT RESIDENTS.

WE ALSO LOOKED AT FIRE RESCUE PERSONNEL.

THIS INCLUDES BOTH FIREFIGHTERS, EMERGENCY RESPONSE PERSONNEL AND SUPPORT STAFF.

PER 1000 FOR THE 2022 YEAR, THERE'S ROUGHLY 1.79 PERSONNEL IN THE FIRE DEPARTMENT PER 1000 RESIDENTS.

BASED ON THE 2023 BUDGET, THERE WAS 2.0, HISTORIC AVERAGE IS 1.84, AND WE RECOMMENDED IN TERMS OF FUTURE PLANNING, LOOKING AT TWO PERSONNEL PER 1000 RESIDENTS.

SIMILARLY FOR FOR POLICE, WE LOOKED AT THE HISTORIC AVERAGE IS 2.49 AND WE LOOKED AT A STANDARD OF 2.5

SWORN OFFICERS, CRIME SCENE INVESTIGATORS AND SUPPORT STAFF FOR THE POLICE DEPARTMENT PER 1000 RESIDENTS.

SO THIS WILL ASSIST THE CITY IF IT CHOOSES TO USE THESE STANDARDS IN TERMS OF ANNEXATIONS, UPDATES, REVIEW OF REZONINGS AND WHAT IMPACT THOSE WOULD HAVE ON CITY SERVICES.

AND THEN WE ALSO LOOKED AT PUBLIC FACILITIES PERSONNEL.

SORRY, WATER.

PUBLIC FACILITIES. PERSONNEL DOES NOT INCLUDE STAFF THAT ARE PART OF PARK AND RECREATION.

DOES NOT INCLUDE PUBLIC SAFETY, WHICH IS POLICE AND FIRE.

THIS IS JUST GENERAL GOVERNMENT.

THIS IS YOUR CITY ADMINISTRATION, YOUR PLANNING DEPARTMENT, YOUR PUBLIC WORKS FOLKS, YOUR IT STAFF.

AND SO THERE'S A PROJECTION OR HISTORIC AVERAGE OF 2.3 PERSONNEL PER 1000 RESIDENTS.

YOU'LL SEE A LITTLE BIT MORE WHAT THIS ACTUALLY ALL MEANS AS WE GO THROUGH THIS FURTHER.

SO LET'S LOOK FIRST AT PARKS AND RECREATION SYSTEM WITHIN THE CITY ITSELF.

TODAY THERE'S 388.95 ACRES.

THAT'S THE STANDARD THAT'S REQUIRED WHEN YOU LOOK AT FIVE RESIDENTS OR FIVE ACRES PER 1000 RESIDENTS.

THE CITY IS PROVIDING 569 ACRES TODAY.

SO WHEN WE LOOK OUT INTO THE FUTURE, WE'RE LOOKING AT BOTH EMPLOYMENT USE OF THE PARK SYSTEM AS THE CITY CONTINUES TO URBANIZE, ESPECIALLY AROUND THE FUTURE RAIL STATION.

AROUND THE GARDENS AT THE MALL.

THE GARDENS MALL REDEVELOPMENT.

THERE'S GOING TO BE A NEED FOR URBAN PARKS, ESPECIALLY EAST OF I 95, AND THAT'S SOMETHING THAT'S REFLECTED IN THIS.

SO THIS LEVEL OF SERVICE STANDARD HAS NOW BEEN EXPANDED TO ALSO INCLUDE EMPLOYEES.

RIGHT NOW IT'S JUST FOR RESIDENTS.

THIS STANDARD IS EXTENDED TO EMPLOYEES AS WELL.

AND SO THAT WOULD GENERATE A NEED FOR 648 ACRES BY 2035.

THE CITY IS ALREADY PROVIDING ROUGHLY 570.

SO THAT MEANS THERE'S AN ADDITIONAL DEMAND FOR ROUGHLY 35 ACRES OF PARK SPACE BETWEEN NOW AND 2035.

WE LOOKED AT THE POTENTIAL FOR DEVELOPMENT AND WHERE THAT SPACE WOULD BE NEEDED, MOST LIKELY AS TERMS OF REDEVELOPMENT AND INFILL DEVELOPMENT.

ROUGHLY TEN ACRES OF THAT WOULD BE EAST OF INTERSTATE 95.

GIVEN HOW DENSE THE DEVELOPMENT IS, AND THE REDEVELOPMENT THAT IS OCCURRING AT TEN ACRES IS GOING TO HAVE TO BE ACQUIRED CREATIVELY, MAY REQUIRE THE REUSE OF SOME STORMWATER MANAGEMENT FACILITIES, SOME LINEAR PARKS.

IT IS SOMETHING THAT WE HAVE TO LOOK AT IN FURTHER DETAIL.

BUT GIVEN THE PROJECTION OF POPULATION AND EMPLOYMENT THAT COULD COME THROUGH REDEVELOPMENT, ROUGHLY TEN OF THOSE ACRES ARE NEEDED THERE.

WE LOOKED AT THE NEED FOR FIVE ACRES BETWEEN I-95 AND THE TURNPIKE.

THAT'S LARGELY DUE TO THE DEVELOPMENT ALONG MILITARY TRAIL AND THE POTENTIAL REDEVELOPMENT OF MILITARY TRAIL.

SOME OF THE COMMUNITIES TO THE WEST ARE RELATIVELY BUILT OUT.

THERE'S NOT GOING TO BE A WHOLE LOT OF REDEVELOPMENT IN THAT AREA.

AND THEN THE HIGHEST GROWTH AREA POTENTIAL OF THE CITY, BOTH IN TERMS OF NEW DEVELOPMENT AND ANNEXATION, WOULD BE WEST OF THE TURNPIKE, AND THIS WOULD GENERATE A NEED, POTENTIALLY FOR 20 ADDITIONAL ACRES.

SO THAT'S THE 35 ACRES NEEDED FOR NEW GROWTH WITHIN THE CITY.

WE'VE ALSO INCLUDED UPGRADES TO EXISTING CITY FACILITIES IN TERMS OF PLANS FOR IMPROVEMENTS AT THE BYRNE ROADS COMMUNITY CENTER. SORRY, I'LL CORRECT THAT TYPO THERE.

FIELD HOUSE AND PGA PARK SPORTS BUILDING AND MIRASOL PARK FACILITY.

WITHIN THE TECHNICAL REPORT ITSELF, THERE'S ACTUALLY A DETAILED LIST OF CAPITAL IMPROVEMENTS THAT HAVE BEEN COORDINATED WITH PARKS AND RECREATION STAFF.

SO IF YOU'D LIKE TO FIND OUT MORE INFORMATION ON THOSE SPECIFIC PROJECTS, THEY ARE INCLUDED IN THAT REPORT.

THE PROJECTION OF OVERALL COST IS ROUGHLY $273 MILLION BETWEEN NOW AND THEN.

THERE ARE SOME LARGE PROJECTS IN THAT OVERALL BUDGET, AND THOSE ARE SOMETHING THAT ARE GOING TO BE FURTHER REFINED OVER THE NEXT FIVE AND TEN YEARS. THERE'S AN ANTICIPATION THAT FUNDING MAY BE AVAILABLE THROUGH EITHER BONDING OR AN EXTENSION OF THE SALES TAX OF ROUGHLY $54 MILLION.

AND THAT LEAVES US A NET COST THAT WE THEN USE TO PROJECT A PARK IMPACT FEE RATE OF $1,812 PER FUNCTIONAL

AND WE DID A COMPARISON.

THERE ARE A FEW OTHER COMMUNITIES WITHIN PALM BEACH COUNTY THAT HAVE PARK AND RECREATION IMPACT FEES TODAY.

I WILL NOTE THAT ANY REFERENCE TO ANY OTHER LOCAL GOVERNMENT OR THE COUNTY, IF YOU WANT SPECIFIC DETAILS ON THOSE IMPACT FEE RATES, YOU SHOULD CHECK WITH THOSE LOCAL GOVERNMENTS. THIS IS JUST A SUMMARY OF THAT INFORMATION.

BUT IN BOCA RATON, THE PARK IMPACT FEE FOR A 2000 TO 4000 SQUARE FOOT DWELLING IS ROUGHLY $4,500.

IN WELLINGTON, IT'S $4,000.

THEY USE A FLAT DWELLING UNIT FEE.

IT DOESN'T MATTER IF IT'S A 1000 SQUARE FOOT SINGLE-FAMILY HOME OR A 6000 SQUARE FOOT SINGLE FAMILY HOME.

THEY BOTH PAY $4,000.

WITHIN ROYAL PALM BEACH, IT'S $2,200.

WITHIN PALM BEACH COUNTY, IT'S $2,332, WHICH WAS CALCULATED FEE.

THEY WENT THROUGH A SIMILAR PROCESS THAT THE CITY IS GOING THROUGH NOW.

UPDATED THE TECHNICAL REPORT AND THIS IS WHAT THEIR NUMBERS SAID.

THE FEE SHOULD HAVE BEEN BECAUSE THEY MADE A DECISION A FEW YEARS BACK TO LOWER THOSE FEES.

STATUTE CHANGED RELATED TO WHAT'S KNOWN AS EXTRAORDINARY CIRCUMSTANCE, WHICH WE'LL GET INTO A LITTLE BIT FURTHER.

AND THAT ESSENTIALLY LIMITED HOW MUCH THE COUNTY COULD INCREASE ITS FEE.

SO IT'S ACTUALLY ADOPTED.

PARK'S RATE IS $951 FOR THAT SIZE OF A HOME.

TODAY WITHIN THE CITY, REGARDLESS OF WHETHER OR NOT THERE AN UPDATE OCCURS.

THE CITY OF PALM BEACH GARDENS CHARGES $4,114 FOR A SINGLE FAMILY HOME THAT'S GREATER THAN 2500 SQUARE FOOT.

TODAY, THAT'S WHAT THE CITY'S EXISTING FEE IS AS PART OF THE UPDATE, BASED ON SQUARE FOOTAGE.

IT'S ROUGHLY $4,000.

ONE OF THE BIG CHANGES IN THE IMPACT FEE ITSELF IS GOING FROM A DWELLING UNIT BASIS OF A FEE PER SOME SQUARE FOOTAGE TIERS TO AN ACTUAL SQUARE FOOTAGE FEE, SIMILAR TO NON RESIDENTIAL USES, SO A SMALLER HOME WOULD PAY COMPARATIVELY LESS.

A LARGER HOME WOULD PAY COMPARATIVELY MORE.

THEY BOTH PAY THE SAME DOLLAR AMOUNT PER SQUARE FOOT, BUT A SMALLER HOME PAYS LESS, A LARGER HOME PAYS MORE, AND WE'LL GET INTO A LITTLE BIT OF THE DETAIL AS IT'S ASSOCIATED WITH THE NUMBER OF BEDROOMS AND THE NUMBER OF PEOPLE LIVING WITHIN THOSE DWELLING UNITS.

AND ALL THAT, THAT WHOLE TECHNICAL REPORT, EVERYTHING THAT I'VE MENTIONED TODAY, THE GROWTH FACTORS, THE CAPITAL IMPROVEMENTS PLAN, THE COST THAT HELPS US PRODUCE THE ACTUAL PARK IMPACT FEE RATE FOR THE CITY.

AND SO THIS HAS BEEN FOR RESIDENTIAL USES.

TODAY, THE CITY DOES SINGLE FAMILY DETACHED AND THEN MULTIFAMILY.

SO IT CONSIDERS A TOWNHOME, A CONDO, AN APARTMENT, THE SAME IMPACT.

AS PART OF OUR DATA ANALYSIS, WE FOUND THAT THEY ACTUALLY HAVE VERY DIFFERENT IMPACTS.

YOU KNOW, THINK ABOUT IT IN TERMS OF.

AN APARTMENT OF 1000FT² HAS AN EQUIVALENT IMPACT OF A TOWNHOME OF 2000FT² IN A SINGLE FAMILY HOME OF 3000FT².

SO YOU THINK ABOUT THE NUMBER OF PEOPLE THAT LIVE IN THAT DWELLING UNIT.

NUMBER OF BEDROOMS MEAN POTENTIALLY MORE PEOPLE LIVING OR VISITING OR STUDENTS COMING HOME, FAMILY COMING DOWN, WHAT HAVE YOU.

BUT GENERALLY, THERE'S BEEN A LOT OF STUDIES OUT THERE THAT HAVE SHOWN THE MORE BEDROOMS, THE MORE IMPACT, THE MORE BEDROOMS, ALSO THE GREATER THE SQUARE FOOTAGE OF THE DWELLING UNIT. AND THEN WE'VE COME UP AND WE'VE ESTABLISHED VARIOUS THRESHOLDS, WHICH ARE MAXIMUM LEVELS AT WHICH THE FEES WOULD BE ASSESSED BASED ON THE DATA THAT EXISTS TODAY IN PALM BEACH GARDENS.

AS YOU SEE, A SINGLE FAMILY IS HIGHER, SINGLE FAMILY ATTACHED.

IT CAPS OUT AT 4500FT², WHICH WOULD BE THE MAXIMUM RANGE.

AND THEN FOR MULTIFAMILY IT'D BE 2500FT².

ANYTHING ABOVE THOSE SQUARE FOOTAGES WOULD NOT BE ASSESSED AN IMPACT FEE.

WE ALSO LOOK TO SIMILARLY TO EMPLOYMENT.

I'M NOT GOING TO GO INTO A WHOLE LOT OF THIS.

IF YOU WANT TO FIND ADDITIONAL DETAIL, IT IS IN THE TECHNICAL REPORT ITSELF.

JUST WANTED TO HIGHLIGHT THAT WE WENT THROUGH A SIMILAR ANALYSIS OF EMPLOYEES SPECIFIC TO PALM BEACH GARDENS.

AND SO WITH THAT, THAT INCLUDES CONCLUDES THE ACTUAL UPDATE OF THE IMPACT FEES THEMSELVES.

AND THE LAST PORTION AND REALLY THE PRIMARY PURPOSE OF THE WORKSHOP TODAY IS EXTRAORDINARY CIRCUMSTANCES.

AND WHAT DOES THAT MEAN? WELL, IN 2021, THE LEGISLATURE AMENDED THE IMPACT FEE ACT, AND THEY SAID THAT ANY LOCAL GOVERNMENT THAT INCREASES OR UPDATES ITS IMPACT FEE, THE MAXIMUM THEY CAN INCREASE IT OVER EXISTING FEES, IS 50%.

SO ANYTHING ABOVE 50%, YOU CAN'T CHARGE NEW DEVELOPMENT FOR THAT.

THEY WENT ONE STEP FURTHER AND THEY SAID, IF YOUR INCREASE IS 25% OR LESS, YOU PHASE IT IN EQUAL INCREMENTS OVER A TWO YEAR PERIOD.

IF IT'S BETWEEN 25% AND 50% INCREASE OVER EXISTING FEES, YOU PHASE IT IN OVER A FOUR YEAR PERIOD.

AND THIS WAS INTENDED TO LESSEN THE IMPACT OF FEE INCREASES ON NEW DEVELOPMENT.

IT WAS ALSO INTENDED TO FOR COMMUNITIES THAT HADN'T UPDATED THEIR FEE IN TEN YEARS, 15 YEARS, 20 YEARS.

SO THEY COULDN'T ALL OF A SUDDEN TRIPLE OR QUADRUPLE THEIR FEE AND SAY NEW DEVELOPMENT NOW OWES YOU BEEN PAYING $1,000 FOR THE PAST 30 YEARS.

NOW YOU'RE GOING TO PAY $5,000 FOR SINGLE FAMILY HOME.

AND THAT WAS WHAT THE INTENT IS, BECAUSE THERE ARE A LOT OF LOCAL GOVERNMENTS IN FLORIDA THAT HAVEN'T UPDATED THEIR FEES.

PALM BEACH GARDENS ITSELF HAS ACTUALLY BEEN PRETTY ACTIVE EVERY 4 TO 5 YEARS UPDATING ITS FEES, WHICH IS ACTUALLY WHAT YOU'RE SUPPOSED TO DO IN TERMS OF STATUTE AND LEGAL REQUIREMENTS.

BUT THE LEGISLATURE DID INCLUDE A PROVISION WHAT'S KNOWN AS EXTRAORDINARY CIRCUMSTANCES.

SO FOR COMMUNITIES THAT HAVE.

SIGNIFICANT GROWTH.

COMMUNITIES THAT ANNEX A LOT OF PROPERTY.

COMMUNITIES THAT EXPERIENCE A SPIKE IN OVERALL COST OF IMPROVEMENTS, OR THOSE THAT GO FROM A PLAN BASED SYSTEM, OR FROM A CONSUMPTION BASED SYSTEM TO A PLAN BASED SYSTEM.

THOSE ARE ALL THE BASES FOR EXTRAORDINARY CIRCUMSTANCE.

BUT LEGISLATURE SAID THEY DID NOT DEFINE THAT TERM.

THEY ACTUALLY TRIED TO DO THIS PAST LEGISLATIVE SESSION, AND THEY LIKELY WILL INTO THE FUTURE.

AS OF RIGHT NOW, IT'S JUST THE DEFINITION.

EXTRAORDINARY MEANS ABOVE AND BEYOND, NOT AVERAGE GROWTH.

BUT IT HAS TO BE SOMETHING THAT'S EXTRAORDINARY.

AND IT'S UP TO YOU AS A LOCAL GOVERNMENT TO DEFINE WHAT THAT MEANS.

AND YOU HAVE TO DEFINE IT IN A STUDY.

THAT STUDY CAN'T BE ANY OLDER THAN 12 MONTHS, AND YOU NEED TO HAVE TWO PUBLIC WORKSHOPS TO CONSIDER IT.

THIS IS THE FIRST WORKSHOP THIS MORNING.

THERE'LL BE A SECOND WORKSHOP THIS EVENING.

AND THEN THE FINAL REQUIREMENT IS THAT TWO THIRDS OF YOUR LOCAL GOVERNMENT BODY ACTUALLY ACTUALLY APPROVE EXTRAORDINARY CIRCUMSTANCE. SO IT'S NOT JUST A SIMPLE MAJORITY OF A COUNTY COMMISSION OR CITY COUNCIL.

IT'S ACTUALLY A SUPERMAJORITY OF THAT BOARD TO MAKE A FINDING OF EXTRAORDINARY CIRCUMSTANCE.

IF. THE CITY COUNCIL DOES NOT APPROVE EXTRAORDINARY CIRCUMSTANCE.

THEN THESE UPDATES WOULD BE PHASED IN PER STATUTE.

SO ANY OF THOSE FEES THAT WERE 70%, 80% OR 100%, THEY WOULD BE CAPPED AT 50% AND THEY WOULD BE PHASED IN OVER FOUR YEARS.

EXTRAORDINARY CIRCUMSTANCE ALLOWS YOU TO ADOPT THE FULLY CALCULATED RATE WITHOUT A PHASE IN SCHEDULE.

THIS IS THE ADVERTISEMENT THAT WAS HELD FOR THIS MORNING'S WORKSHOP AND THIS EVENING'S WORKSHOP, AND ONE OF THE BIGGEST FACTORS WE'VE LOOKED AT, I'VE LOOKED AT IT STATEWIDE RECENTLY, GONE THROUGH A SIMILARLY PROCESS WITHIN PALM BEACH COUNTY IN TERMS OF LOOKING AT THEIR EXTRAORDINARY CIRCUMSTANCE.

AND ONE OF THE DISCUSSIONS WITH THE BUILDERS, THE DISCUSSIONS WITH A LOT OF THE FOLKS.

THE STATE OF FLORIDA IS GROWING FAST.

IT'S ONE OF THE FASTEST GROWING STATES IN THE ENTIRE US, AND IT'S A LARGE NUMBER.

SO YOU'RE JUST NOT GETTING TO A WHOLE LOT OF DETAIL IN MATH.

BUT IF YOU'RE GOING TO MAKE A COMPARATIVE ANALYSIS, IT'S EASY TO SAY, COMPARE THE GARDENS TO JUPITER OR THE GARDENS TO OVIEDO AND CENTRAL FLORIDA. 50,000 RESIDENTS, 60,000.

ANY INCREASE OR PERCENTAGE INCREASE CAN LOOK OUTSIZED BECAUSE IF YOU HAVE 5000 RESIDENTS, YOU HAVE 6000 BASES.

IT'S GOING TO SHOW YOU HAVE HUGE POPULATION GROWTH.

SO WE LOOKED AT ARE YOU GROWING FASTER THAN THE STATE OF FLORIDA? PRETTY SIMPLE QUESTION.

THE STATE OF FLORIDA HAS EXTRAORDINARY GROWTH.

IF YOU'RE GROWING FASTER THAN THE STATE OF FLORIDA, MOST LIKELY MEANS YOUR COMMUNITY IS ALSO EXPERIENCING EXTRAORDINARY GROWTH.

DOESN'T MEAN THAT IF YOUR COMMUNITY IS GROWING, THERE'S NOT NEW PEOPLE COMING TO IT, BUT IT ISN'T NECESSARILY EXTRAORDINARY.

AND THAT'S A PROCESS WE LOOKED AT IN TERMS OF PRIOR STUDIES AND THIS STUDY.

ORANGE COUNTY. MIAMI.

DADE COUNTY. BROWARD COUNTY.

PALM BEACH COUNTY.

THEY'RE ALL RELATIVELY LARGER.

IN THE 1980S AND 1990S, THEY WERE ALL ABOVE FLORIDA AS THEY SORT OF BUILT OUT MORE URBANIZED.

THEIR PERCENTAGE OVERALL IS ACTUALLY DECREASED OR IT'S LOWER THAN FLORIDA.

IF YOU'VE BEEN TO OTHER PORTIONS OF THE STATE, DUVAL COUNTY, WHICH IS JACKSONVILLE, ORLANDO, WHICH IS ORANGE COUNTY OR TAMPA, HILLSBOROUGH COUNTY, THEY'RE EXPERIENCING WHAT?

MIAMI DADE, BROWARD AND PALM BEACH COUNTY EXPERIENCED IN THE 80S AND 90S TODAY.

THEY'RE ALL GROWING FASTER THAN THE STATE OF FLORIDA.

AND THERE ARE TWO COMMUNITIES WITHIN PALM BEACH COUNTY THAT ARE GROWING FASTER THAN THE STATE OF FLORIDA AS WELL.

WESTLAKE, WHICH STARTED OUT WITH 15 RESIDENTS.

SO ANY WESTLAKE GROWTH IS EXTRAORDINARY BECAUSE YOU ADD 15 RESIDENTS AND NOW YOU HAVE 100% INCREASE IN POPULATION.

IN TERMS OF LARGER CITIES, THE OTHER FASTEST GROWING ONE WITHIN PALM BEACH COUNTY IS THE ONE WE'RE IN TODAY.

PALM BEACH GARDENS.

PALM BEACH GARDENS SINCE THE 80S HAS BEEN GROWING FASTER THAN THE STATE OF FLORIDA.

AND IT'S ALSO PROJECTED TO GROW FASTER THAN THE STATE OF FLORIDA OUT TO 2035 AS WELL.

SO THAT IS ONE OF THE BIGGEST FACTORS IN TERMS OF EXTRAORDINARY CIRCUMSTANCE.

YOU HAVE A LOT OF POTENTIAL GROWTH IN THIS COMMUNITY IN ORDER TO MAINTAIN THE HIGH LEVELS OF SERVICE THAT THIS COMMUNITY HAS BEEN PROVIDING TO ITS RESIDENTS AND ITS BUSINESSES. THERE IS A NEED FOR ADDITIONAL CAPITAL FACILITIES, AND WE BELIEVE THAT GROWTH IS EXTRAORDINARY, AND IT REALLY DOES FORM THE BASIS FOR THE CITY COUNCIL, IF THEY SO CHOOSE TO ADOPT THESE IMPACT FEES AT THEIR CALCULATED RATE AND TO NOT PHASE THEM IN.

WE ALSO LOOKED AT OTHER METRICS AS WELL IN TERMS OF INCREASES IN POTENTIAL TRAFFIC.

THE ESTABLISHMENT OF LEVEL OF SERVICE STANDARDS, WHICH A LOT OF LOCAL GOVERNMENTS ARE MOVING TOWARDS TODAY ON THE MOVEMENT FROM A CONSUMPTION BASED FEE TO AN IMPROVEMENTS BASED FEE.

AND WHEN YOU SAY IMPROVEMENTS, IF YOU WANT TO SEE HOW THE FEE IS CALCULATED, THERE'S A LIST OF PROJECTS.

THAT LIST OF PROJECTS DRIVES HOW MUCH THE RATE IS.

IT'S VERY TRANSPARENT.

IT'S NOT BASED ON WHAT THE CITY HAS DONE IN THE PAST, WHAT THE COUNTY HAS DONE IN THE PAST, AND THAT'S GOING TO BE PROJECTED IN THE FUTURE.

IT'S HERE'S A SPECIFIC LIST OF IMPROVEMENTS TO ACCOMMODATE FUTURE GROWTH.

AND SO IT'S VERY TRANSPARENT IN TERMS OF HOW THE CALCULATION OCCURS.

AND ALSO THERE'S A NUMBER OF LAND USES THAT HAVE BEEN UPDATED AND STREAMLINED.

AND THE HOPE IS WITH MOVING FORWARD WITH THIS ADOPTION.

IN FIVE YEARS.

WHEN THIS IS UPDATED AGAIN, THE CITY MAY NOT NEED TO CLAIM EXTRAORDINARY CIRCUMSTANCE BECAUSE IT'S ALREADY GONE TO A PLAN BASED IMPROVEMENT SYSTEM.

IT'S ALREADY GONE THROUGH THIS DETAILED ANALYSIS, AND I'VE JUST GONE THROUGH THIS EXERCISE UP IN ALACHUA COUNTY.

THEIR PARKS IMPACT FEE.

THEY WENT TO A.

A MASTER PLAN.

THAT MASTER PLAN BASICALLY WAS A COMPLETE REDO AND A COMPLETE DIFFERENT LOOK AT HOW THEY PROVIDED PARK SYSTEM.

THEIR FEE INCREASED BY 200 AND 300%.

BUT BECAUSE IT'S BASED ON A DETAILED LIST OF PROJECTS THEY MADE A FINDING OF EXTRAORDINARY CIRCUMSTANCE.

THERE WERE ONE OF THE FIRST ONES TO ADOPT A MOBILITY PLAN AND A MOBILITY FEE TEN YEARS AGO.

WELL, THAT FEE LOOKED OUT 20 YEARS INTO THE FUTURE.

SO ALL THE INCREASES WERE ALREADY PROJECTED TO BE WHAT THEY WERE 20 YEARS IN THE FUTURE.

THOSE INCREASES, EVERY SINGLE ONE OF THEM WAS LESS THAN 50%.

ON AVERAGE. THEY WERE 25% BECAUSE IT WAS BASED ON PLAN IMPROVEMENTS FOR FUTURE NEED.

SO MOST LIKELY WHAT YOU'RE GOING TO SEE IN THE GARDENS INTO THE FUTURE, BECAUSE IT'S PLAN BASED, YOU'RE NOT NECESSARILY GOING TO SEE A 70% AND 80% INCREASE. YOU MAY SEE A TEN, 15, 20% INCREASE BETWEEN NOW AND FIVE YEARS INTO THE FUTURE.

AND THAT'S JUST A BREAKDOWN OF THE INCREASE IN POPULATION.

WE WENT BACK ALL THE WAY TO 1990.

BEFORE 1990.

IT'S A LITTLE BIT HARDER TO FIND SPECIFIC DATA RELATED TO PALM BEACH GARDENS.

THE BUREAU OF ECONOMIC BUSINESS RESOURCES IS THE PRIMARY SOURCE OF THIS ARE THE UNIVERSITY OF FLORIDA.

THEY PROVIDE STATEWIDE PROJECTIONS THAT ARE USED FOR PLANNING CALCULATIONS BY LOCAL GOVERNMENTS AND THE FLORIDA LEGISLATURE.

AND AS YOU SEE IN ALL THESE METRICS, PALM BEACH GARDENS IS GROWING FASTER THAN PALM BEACH COUNTY, AND IT'S ALSO GROWING FASTER THAN THE STATE OF FLORIDA.

WE ALSO LOOKED OUT INTO 2035 USING THE MEDIAN PROJECTIONS, WHICH FOR PLANNING PURPOSES IS WHAT MOST LOCAL GOVERNMENTS DO WITHIN THE STATE.

I'M USING THOSE MEDIAN PROJECTIONS.

PALM BEACH GARDENS IS STILL GROWING FASTER THAN THE STATE OF FLORIDA, GROWING FASTER THAN PALM BEACH COUNTY.

WE ALSO LOOKED AT THE HIGH PROJECTIONS, AND FOR THIS NUMBER, I LOOKED AT THE POTENTIAL FOR ANNEXATION PLUS NATURAL GROWTH.

AND YOU SEE THAT GARDENS IS POTENTIALLY GROWING SIGNIFICANTLY FASTER THAN THE OVERALL STATE OF FLORIDA AND PALM BEACH COUNTY, EVEN USING HIGH PROJECTIONS.

AND THAT GROWTH REALLY IS GENERATING THE NEED.

AND THAT REALLY IS THE PRIMARY BASES FOR EXTRAORDINARY CIRCUMSTANCES.

THE REPORT ITSELF GOES INTO ROUGHLY 30 PAGES OF DETAIL OF WHY EXTRAORDINARY CIRCUMSTANCES IS RELEVANT, BUT THE POPULATION GROWTH IS ONE OF THE MOST SIGNIFICANT FACTORS.

UM. AND WHY ARE WE DOING THIS? BECAUSE SOME OF THESE FEES DO EXCEED 50%.

SPECIFICALLY THE THREE CATEGORIES CONSISTENTLY ACROSS ALL THE UPDATES OVERNIGHT LODGING.

PRIVATE EDUCATION.

COMMERCIAL STORAGE.

UNDER CURRENT STATUTE, THESE WOULD ALL BE LIMITED TO 50%.

SO THEN IN FIVE YEARS FROM NOW, YOU'RE FALLING BEHIND.

EVERY TIME YOU GO TO UPDATE THIS, YOU'VE NEVER FULLY CALCULATED THE FEE.

SO ANY FUTURE UPDATE, THESE FEES ARE ALWAYS GOING TO BE HIGHER INTO THE FUTURE BECAUSE THEY'RE NOT FULLY ACCOUNTING FOR THE IMPACT TODAY.

UNDER THIS SCENARIO, SHOULD THE CITY COUNCIL ADOPT IT, THEY WOULD BE ACCOUNTING FOR THE FULL IMPACT AND LIKELY INTO THE FUTURE.

THERE WOULD BE LESS OF AN INCREASE FOR THESE USES.

SIMILARLY FOR RESIDENTIAL USES ON A PER 1000 SQUARE FOOT BASIS.

ALL THE OTHER CATEGORIES OF FEES ARE LOWER FOR POLICE PROTECTION, ARE A LITTLE BIT HIGHER IN TERMS OF SINGLE FAMILY ATTACHED AND MULTIFAMILY, BUT IN GENERAL, THE FEES ARE ACTUALLY ALL LOWER BECAUSE IT'S GONE FROM A THRESHOLD THAT WAS SOMEWHAT ARBITRARY IN NATURE TO ACTUALLY PALM BEACH GARDENS SPECIFIC DATA.

AND SO I RAN SOME EXAMPLES.

I'M NOT NECESSARILY SAYING THAT A FEE CALCULATED IS AUTOMATICALLY LOWER.

THEREFORE WE DON'T HAVE TO EVEN ADDRESS WHAT THE ACTUAL LIKELY DEVELOPMENT IS.

SO WE LOOKED AT THE AVERAGE SQUARE FOOTAGE OF DWELLING UNITS.

WE LOOKED AT A ROUGH NUMBER OF EXAMPLES AND.

EACH ONE OF THE IMPACT FEES INCLUDES SINGLE FAMILY HOME AT A 3000 SQUARE FOOT LEVEL, A 1300 SQUARE FOOT LEVEL FOR TOWNHOMES, A ONE 250 SQUARE FOOT LEVEL FOR MULTIFAMILY, AND SHOWS WHAT THOSE PERCENTAGE INCREASES WOULD BE.

SO, AS YOU SEE AS THE SQUARE FOOTAGE GOES UP.

THE FEE INCREASES, BUT CONVERSELY, AS SQUARE FOOTAGE GOES DOWN AND SMALLER UNITS TEND TO BE MORE AFFORDABLE IN NATURE, THEY WOULD ACTUALLY PAY A LOWER FEE POTENTIALLY THAN WHAT THEY'RE PAYING TODAY.

AND THESE ARE JUST SORT OF THE BASES FOR EXTRAORDINARY CIRCUMSTANCE.

IT'S DOCUMENTED AND DETAILED IN THE NEEDS STUDY.

BUT THE PRIMARY FACT THE TWO LARGEST FACTORS ARE.

THE CITY HAS BEEN EXPERIENCING EXTRAORDINARY GROWTH.

IT'S LIKELY TO CONTINUE TO EXPERIENCE EXTRAORDINARY GROWTH.

THAT EXTRAORDINARY GROWTH IS CREATING A NEED FOR FUTURE FACILITIES, WHICH IS DOCUMENTED IN THE ACTUAL REPORT ITSELF.

THAT'S REALLY THE PRIMARY BASIS DRIVING THE REQUEST AND RECOMMENDATION TO PURSUE EXTRAORDINARY CIRCUMSTANCES.

AND THE ONE OTHER CONSIDERATION.

FOR THE PAST ALMOST 20 YEARS NOW, THE LEGISLATURE HAS BEEN MAKING AMENDMENTS TO THE LAND DEVELOPMENT RULES, THE LAND USE RULES THAT ALL LOCAL GOVERNMENTS FOLLOW THROUGH FLORIDA STATUTE.

AND CONSISTENTLY, THE LEGISLATURE IS PREEMPTING LOCAL GOVERNMENTS ABILITY TO REGULATE LAND USES WITHIN ITS BOUNDARIES.

A FEW YEARS BACK, THERE WAS ACTUALLY AN AMENDMENT TO SAY IMPACT FEES, REGARDLESS OF YOUR STUDY, COULD ONLY INCREASE 3% A YEAR.

THAT'S IT. IT DOESN'T MATTER WHAT YOUR DATA ANALYSIS SHOWED, THEY CAN ONLY INCREASE 3% A YEAR.

ULTIMATELY, THAT WAS FOUND NOT TO BE THE CASE, BUT THAT FORMED THE BASIS FOR EXTRAORDINARY CIRCUMSTANCES FORMING THE BASIS FOR THE CAP FORMED THE BASIS FOR PHASING IN THOSE USES.

AND THERE IS NO GUARANTEE THAT IN THE FUTURE THE LEGISLATURE IS GOING TO ALLOW EXTRAORDINARY CIRCUMSTANCES.

SO IF YOU DON'T NECESSARILY MOVE FORWARD WITH ADOPTION OF THESE CALCULATED RATES, THERE'S NO GUARANTEE IN THE FUTURE YOU'RE GOING TO HAVE THAT OPPORTUNITY AGAIN.

AS A CITY COUNCIL PUBLIC WORKSHOP IN THE CITY COUNCIL CHAMBERS ON THURSDAY, NOVEMBER 2ND, 2023.

A FIRST READING IS SCHEDULED BEFORE THE CITY COUNCIL AND ON WEDNESDAY, DECEMBER 6TH, A 2023 A CITY COUNCIL SECOND READING IS SCHEDULED IF THE COUNCIL ADOPTS THE IMPACT FEE AS RECOMMENDED.

STAFF PLANS TO ISSUE A NOTICE IN DECEMBER FOR A MINIMUM OF 90 DAYS, WITH THE FEES EFFECTIVE APRIL 1ST.

AND WITH THAT, I WOULD LIKE TO CONCLUDE THE PRESENTATION, AND I WOULD LIKE TO ASK THE CLERK IF THERE ARE ANY COMMENT CARDS.
